Manoj Madhusudhanan took a home loan of ₹1.86 crore from ICICI Bank in 2016 to buy property in Bengaluru. He did everything right. He signed the papers. He handed over his original property documents — the registered sale deed, the possession certificate, the title papers — to the bank as security. These are irreplaceable documents. The kind that define legal ownership of a home. ICICI Bank lost them. ICICI Bank retained the original property documents including the registered sale deed and possession certificate. As the bank did not provide scanned or true copies of these documents, Madhusudhanan filed a complaint in June 2016, following which the bank informed him that the documents had been lost in transit from Bengaluru to its central storage facility in Hyderabad, by a courier company. They had entrusted your irreplaceable legal papers to a courier. And the courier lost them. ICICI Bank's response? It's the courier's fault. This is where the story gets important. ICICI Bank tried to tell Madhusudhanan: we'll give you certified copies. Don't worry. Copies are just as good. He disagreed. The original sale deed, signed before a registrar, is a document of legal standing that no photocopy fully replaces. Future transactions, disputes, inheritance claims — all would now carry a cloud of uncertainty. He asked for ₹5 crore in compensation. He approached the NCDRC — India's apex consumer court. ICICI Bank argued: talk to Bluedart. They're the ones who lost it. Not our problem. The NCDRC held that the safe custody of the documents was the liability of the bank, and not the courier service. The bank is the custodian. The bank chose the courier. The bank cannot outsource its liability to a third party you never contracted with. The NCDRC directed ICICI Bank to obtain, at its expense, all reconstructed and duly certified copies of the documents, issue an indemnity bond, and pay compensation of ₹25 lakh along with ₹50,000 as reimbursement for litigation expenses. Failure to comply within eight weeks would trigger 12% annual interest. ICICI Bank is India's second-largest private bank. Their annual profit runs to thousands of crores. The cost of keeping a customer's documents safe is negligible. The cost of not doing so — it turns out — is ₹25 lakh and a binding indemnity bond. What this case established goes beyond ₹25 lakh. The indemnity bond means ICICI Bank is now legally responsible for any future loss Madhusudhanan suffers because his original documents are gone. Any legal dispute, any ownership challenge, any transaction complication — the bank is on the hook. The court understood what the bank did not: an original document isn't just paper. It's the legal foundation of a family's asset. One home loan. One lost deed. One bank that tried to blame the courier — and failed. Save this — If you have a home loan and your bank holds your original property documents, you have the right to demand regular status updates, scanned copies, and a clear chain of custody. If they lose your documents: the bank is liable — not the courier they hired. You are entitled to compensation and an indemnity bond. NCDRC has ruled this clearly. When men have the freedom to spend a part of their money that they earned in whatever way they want, why aren't women allowed the same? Why are women asked to inform the husband/in-laws about any money that they spend on themselves or their maternal side of the family?
