A three-judge federal appellate panel intervened quickly against you and in favor of the government in a foreign-policy case. U.S. courts are often deferential to the executive branch on sanctions, national security, and foreign affairs. The fact that Judges Henderson, Katsas, and Childs granted emergency relief to Secretary Rubio suggests the government’s arguments are being taken seriously at the appellate level. It signals skepticism toward the district court’s injunction. The judges explicitly said the administrative stay was not a merits ruling. But appellate courts do not lightly restore sanctions in a high-profile constitutional case unless they believe the government has at least a plausible and substantial basis for reversal. Procedurally, this shifts momentum toward Secretary Rubio.
