It's still Fall, but I'm looking forward to hitting the ski slopes this winter. Took a nice walk around Blue Mountain Village a few weeks back. The Niagara Escarpment is beautiful in all seasons, but it's magical at night under a fresh blanket of snow. ❄️ ☃️ 🎿

I can’t think of a good reason to keep the evaluation criteria or review instruments under wraps. Transparency helps authors know what to aim for, there may be fewer revisions required as a result, and standards would improve. What are your thoughts?

Still working through a full analysis but my instinct is that LMEs offer a superior approach, where feasible. The persistent use of non-insolvency workouts/LMEs/etc. sheds light on the uneasy fit - in my view - of restructuring as a policy objective of bankruptcy/insolvency law.

Digging into Xplore Inc. (Re), 2024 ONSC 5250 and related decisions this week, for research on liability management exercises (LMEs). Fascinating stuff. Still getting my head around various mechanisms and terminology like "up-tiers", "drop downs", "double dips" & "pari plus."
