Pakistan has a single-digit conviction rate, partly because appellate courts are more than happy to hand out acquittal after acquittal for violent crimes (while ignoring hundreds of unjustly imprisoned activists, like Imaan Mazari and Hadi Chattha). Vile murderers go free over minor technicalities or, if they’re rich, for paying their way out through coerced compromises. A rare exception is the occasional gruesome child homicide case, as this one was, when even a system as broken as ours is forced to hand down punishment. There is zero impetus for qisas-diyat reform, or for better prosecution and conviction, or for less vacuous decisions. Even when the police and prosecutors do their job, judges again let the killer go through the most incomprehensible reasoning, as the Lahore High Court’s Justice Sohail Nasir did in the Qandeel murder case. Speaking up for the ‘utility of deterrence’ is well and good, but shouldn’t have to require a vicious child murder. When the entire justice system is rigged against such deterrence, there needs to be a complete overhaul.
