⚖️COURT UPDATE⚖️Daystar Peterson, professionally known as Tory Lanez, has been DENIED expedited discovery in his federal lawsuit against California correction officials and the California Department of Corrections and Rehabilitation. In a June 17, 2026 order, Magistrate Judge Anna Y. Park denied Peterson’s motion for expedited discovery, which sought early production of information to identify the Doe correctional officers allegedly involved in the May 12, 2025 prison stabbing incident. Peterson’s lawsuit alleges he was stabbed approximately 16 times by inmate Santino Casio while housed at California Correctional Institution. According to the court’s summary of the complaint, Peterson alleges he was airlifted in critical condition to Kern Medical Center, placed on a ventilator, and later transferred to an infirmary before being moved to California Men’s Colony. Peterson’s complaint asserts claims including failure to protect, deliberate indifference, negligence, negligent supervision or training, intentional infliction of emotional distress, violation of privacy rights, and conversion. The court’s order notes that Peterson seeks $100 million in damages. The expedited discovery motion asked for reports, logs, documents, staff names, titles, badge numbers, metadata, timestamps and electronic logs RELATED to the May 12, 2025 incident and medical care. The court found Peterson DID NOT show good cause for early discovery. Judge Park wrote that expedited discovery to identify Doe defendants is usually permitted where a plaintiff cannot identify any defendant and where there is a legitimate fear that identifying information may be destroyed. The court said Peterson DOES NOT face those circumstances. The order notes that Peterson can seek discovery from named defendants during the normal discovery process and that he had not yet served the named defendants, including Warden Danny Samuel and CDCR. The judge also found Peterson HAD NOT shown he exhausted traditional avenues for identifying the Doe correctional officers and had not argued that relevant information was in danger of destruction. The court further said Peterson’s discovery requests were too broad to be limited to identifying Doe defendants. According to the order, the requests appeared more like an attempt to conduct broad merits discovery before the Rule 26(f) conference, rather than a narrowly tailored effort to learn names. Separately, CDCR and Peterson’s counsel filed a stipulation extending CDCR’s deadline to respond to the initial complaint. The filing states the complaint was served May 27, 2026, CDCR’s response was originally due June 17, 2026, and the new response deadline is July 17, 2026.
