Also there’s a decent chance the client that got wrecked will thank you for the rest of their life and the one you pulled off a miracle for will file a bar complaint.
(╯°□°)╯︵ ┻━┻@kemichels

reminded again today that as a public defender you'll have the most beautiful thing happen for one client and the most horrible thing you can think of happen for another client all within a span of a week 😖

Liberals have really screwed up collective bargaining in federal sector. “Intervention Expectation” is my newly coined phrase. Going in my textbooks. Now parties weigh every proposal against whether they’d likely do better if arbitration is imposed. This impedes bargaining.

We stand against government intervention and ask for the Air Canada Flight Attendants’ collective bargaining rights to be respected.

@ASFleischman Findings of guilt are actually determined by moose race in criminal matters. Trial by beaver is only for civil cases. In all seriousness the bar up here is understandably up in arms about this opinion which reeks of its own form of misogyny

This is from a Canadian, so presumably they resolve guilt by seeing if a beaver can chew through the defendant's chair in an hour or less but still

Female criminal defence lawyers are not ‘human shields in skirts.’ We are skilled, principled advocates in a male-dominated field. Misogynistic takes like this push women out of the profession—and that’s exactly the problem.” #CriminalDefence #WomenInLaw

This kind of nonsense that can only come from a small thinker. It is not writing with "courage and candour". It is an insult to the star lawyers (some of whom were addressed as "Ms.") that prevented a miscarriage of justice: Why do female lawyers represent men in sexual crimes?

The Star should be ashamed for even publishing this trash. I’m inclined to cancel my subscription all together. Why would female lawyers represent men in sexual crimes? thestar.com/opinion/star-c… via @torontostar

@DougtheLawyer The exercise itself is one thing; but wouldn’t this be better if the person doing the running was a member of staff or a law student? Counsel’s made himself a witness

What I love about things like this is the creativity and ingenuity of defense lawyers. What I hate about it is knowing that I live in a jurisdiction where the judges would exclude this kind of evidence and the appellate court would uphold that decision.
Interesting things@awkwardgoogle

An officer claimed it was impossible for anyone to exit a car and get over the embankment in under 30 seconds, so Attorney Matt Brock from Chattanooga recorded this reenactment, proved him wrong, and won the case.

@alittleleader That was the case here too— but then our Supreme Court imposed hard time limits on proceedings beyond which they must be stayed (30 months in superior court) and the legislative response was to restrict the availability of prelims. It has not helped.

Because I’ve only ever practiced in VA I’m curious to hear from criminal defense ppl— in most other places in the US, if the prosecutor loses a preliminary hearing/probable cause hearing for lack of evidence, is there a mechanism for them to proceed to trial on the case anyway?

@profbenperrin @MarkJCarney Query how adding hate motivated murders as constructive first will make any practical difference--in what scenarios would the Crown be able to prove a hate purpose but not able to prove planning and deliberation?

Today @MarkJCarney announced some specific, concrete measures to enhance public safety. Research consistently shows harsher penalties don't deter. What does deter is increasing the probability of apprehension. This makes Carney's plan superior to Poilievre's. Carney's plan focuses on practical steps to address gun crime in particular, child exploitation, securing the border, and targeted increases to RCMP and CBSA in priority areas, among other things. Details in the link. liberal.ca/mark-carneys-l…
