A whistleblower transplant surgeon believes some organ donors may still feel pain during organ harvesting. Dr. Claire Morgan is raising awareness about even more problems with the already controversial practice of NRP organ procurement. In this technique, organs are removed from a patient who is not brain dead, but who has a poor prognosis. When these people become organ donors, a “do not resuscitate” order is given because while they could be resuscitated, a decision has been made not to do so. Their support is withdrawn, and once they become pulseless, doctors wait just 2-5 minutes to be sure the heart doesn’t re-start on its own before making incision. Then, for NRP donation, surgery begins with clamping the major arteries to the patient’s brain in order to make the person brain dead on purpose. Following this,the rest of the body is hooked up to a cardiac bypass or ECMO machine and a complete resuscitation of the organs is performed such that the patient’s heart starts beating again in their own chest. People already question whether NRP donors are being legally declared dead under the Uniform Determination of Death Act (UDDA), because initially their death is declared under the UDDA’s “irreversible cessation of circulatory and respiratory function” clause…but then the heart is restarted, showing that the cessation wasn’t actually irreversible after all. To get around this, doctors make the patient brain dead on purpose so that now their death is defined under the UDDA’s “irreversible cessation of all functions of the entire brain” clause. But what Dr. Morgan has personally witnessed is that surgeons DON’T always clamp off all the blood flowing to the brain. Such patients could then be aware and suffering as their organs are being surgically removed. Dr. Morgan has filed a complaint with the US Department of Health and Human Services, and has written to a network compliance and safety investigator: “This situation is intolerable and cannot be dealt with over the usual timeframe. I have no way of knowing how often what I have seen is occurring in other operating rooms.” Giuliano Testa, abdominal transplant chief at Baylor University Medical Center, also worries about the lack of informed consent. He thinks that instead of checking a box at the DMV, donors should fully understand what they are signing up for: “What kind of consent is that?” he said. “It’s not consent. Bullshit.” Dr. Morgan herself is no longer a registered organ donor, and is surprised that the practice of NRP is continuing despite its medical, legal, and ethical problems: “Somebody is going to get sued over this, and it’s not going to be me,” she said.
