Christophe Dorigné-Thompson has produced here (One Single Page Against a nation.... ) tinyurl.com/23yogwrc a piece of significant scholarly importance on the Scottish Parliament's SP Paper 1030 concerning "legal routes" to independence. He also addresses what is destined to become Westminster's notorious case-destroying rider: a single page of imperious dismissal telling Scots what really concerns them (clue - it's not an independence vote) and consigning each of the Paper's 109 paragraphs - authored by 12 UK academic experts - to little more than pure hot air. The hottest air of all may have come from Professor Aileen McHarg, who, as Chris puts it, opined that colonialism exists "elsewhere, in the past, across the water." Ms McHarg fails to mention the numerous contiguous states internationally designated as annexed and colonised territories. More significantly, she ignores that, for Scotland, colonial status by the diligence of Liberation Scotland is now documented in UN Human Rights Council document A/HRC/61/NGO/210 documents.un.org/doc/undoc/gen/… Disgracefully, given the leadership of the SNP in the production of this document, the terms of reference of SP Paper 1030 explicitly excluded all considerations outside the hermetically sealed landscape of British state constitutional constraints - constraints infamously and correctly identified by Lord Cooper's famous obiter as having no counterpart in Scottish constitutional law. The shibboleth of parliamentary sovereignty, to which our SNP MSPs have, to their great shame, once again paid homage, is no more than an imperialistic confection and administering Power imposition. This is a long academic piece, but we recommend that all independence-seeking Scots read it. It covers the constitutional issue for Scotland in detail and with a clarity rare in Scottish constitutional discourse. Moreover, it offers a dimension of international precedent and addresses the entire question of the origins of the constraining orthodoxy of what the Westminster Parliament brazenly calls "our" constitution - dimensions entirely missing from the Scottish Parliament's paper and the self-limiting thinking of its seamlessly-integrated British state consultants.
