General legal principle has always been that NADRA documents registered prior to incident are deemed credible. Timeliness of registration was never an issue. FCC has introduced new absurd logic in a country where only recently NADRA established mega centers to ease registration

The Federal Constitutional Court (FCC)  in Islamabad, has upheld the legality of a marriage between a Christian minor girl and a Muslim man nearly double her age, dismissing a petition filed by her father seeking her return through a habeas corpus plea. Speaking to Voicepk, Shahbaz Masih complained that the court had been unfair in its decision, saying that they had done everything to try and get their daughter back, but he could feel the systemic discrimination. Minority Rights March raises serious questions over Federal Constitutional Court’s decision upholding an alleged underage child marriage. The group said that it was appalled and angered by the Order issued by a two member bench of the Federal Constitutional Court in the case of a minor Christian girl child, Maria Shahbaz, who is a victim of the crimes of abduction and child marriage, and may also be perpetually exposed to other heinous offences by her abductor. The FCC not only refused to restore custody of the victim to her father, but failed to rescue the minor victim by legalizing her cohabitation with her abductor under the garb of a “Nikkah” which itself entails penal consequences under the Child Marriage Restraint law.
