At the end of the day, 4chan has a right to refuse Ofcom's orders. In America, Ofcom's orders are unlawful orders. It is entirely right and proper for 4chan to refuse those orders and to thereby defend free speech in the United States.

"What if they block 4chan in the UK?" That's the UK's domestic business. My client will not be a party to the increasing censorship of the British people. If the UK wants to censor the Internet, they will need to do it without 4chan's assistance.

If Ofcom thinks its orders are enforceable here, it is welcome to come to America and try to enforce them in an American court. In the meantime, I'd really appreciate it if the agency would stop threatening American citizens.

British media have uncritically carried water for the Online Safety Act for years. Legal reality is that Americans, in America, are lawfully entitled to refuse to comply with government censorship, whatever its source. That's what it means to have free speech.

The Online Safety Act was promised as domestic legislation to protect children from online harms. In reality, its regulator (Ofcom) has demonstrated sinister extraterritorial ambitions that now affect US tech companies and the First Amendment rights of American citizens. Ofcom has fined US messaging platform 4chan £520,000 (plus £800 per day), claiming the company failed to comply with the Act’s risk assessment duty, its illegal content safety duty, and its children’s safety duties.
