Compliance Tip of the Week: ESP Access to Customer Data & Disclosure
Accountability Access to customer data by External Service Providers (ESPs) must be intentional, documented, and transparent, never assumed. Organizations should formally define when and why ESPs are permitted to access customer data, ensure that access is limited to the minimum necessary, and require written acknowledgment of data handling and disclosure responsibilities.
Customers must be clearly informed of any ESP access that could impact the confidentiality, integrity, or availability of their data, including the nature and purpose of that access. Maintain signed agreements, data access disclosures, and supporting evidence in a centralized location to support audits and compliance reviews. Regularly reassess ESP access rights and disclosure language, especially when service scopes change or new risks emerge. By clearly documenting ESP data access and reinforcing disclosure accountability, organizations strengthen customer trust and demonstrate effective third-party risk management.
