I am a #Canadian woman serving as a medic in the Armed Forces of Ukraine. I have seen what this war does up close. I have seen soldiers joke through exhaustion because if they stop laughing, they might break. I have seen villages emptied, animals left behind, homes turned into ruins, and good people carrying more pain than any human should ever have to carry. And still, every day, our people keep going. If a “Trudeau-appointed judge” on the Alberta Court of King’s Bench is automatically conflicted on an Alberta separation case, then by that logic an Alberta-based judge should also be viewed as conflicted because of local ties and provincial government backing. Or any provincially appointed or recommended judge for that matter. Yet that’s not how our system works, and here’s why: 1. The Constitution deliberately makes superior court judges (King’s Bench) federally appointed. This isn’t a bug — it’s a feature. It’s designed to give an independent check on provincial power, especially on big constitutional issues like secession, treaty rights, and national unity. 2. Provincial courts (Alberta Court of Justice) are fully provincial and handle most everyday cases, but this kind of constitutional challenge starts directly in the superior court. 3. The legal test for removing a judge isn’t “who appointed them” or “which province they sit in.” It’s whether a fair-minded observer would see a real risk of bias. Geography plus appointment source alone doesn’t meet that test. Flipping the argument exposes the tension: if we start presuming every judge is captured by whoever appointed them (Ottawa or Edmonton), the entire justice system collapses. Courts hear challenges against the government that appointed them all the time. Premier Smith and Stay Free Alberta strongly disagree with Justice Leonard’s ruling — that’s fair. The proper response is the appeal they’ve already announced, potentially all the way to the Supreme Court of Canada. Not declaring the bench itself untrustworthy. Rule of law means living with outcomes you don’t like while using the lawful process to challenge them. The symmetry cuts both ways. What do you think — does the current appointment system need reform (more provincial say), or is the federal check valuable?
