The Next #MenendezBrothers' Parole Hearings The California Parole Board found Erik and Lyle Menendez "not suitable" for release and called them "a moderate risk" to the people of California if they were set free when they appeared before the board in late August 2025. The L.A. County DA's office was allowed to have a deputy DA argue against the brothers being paroled as part of the ten hour (Erik) and 11 hour (Lyle) individual hearings on Aug. 21 and 22, 2025. The average California parole hearing lasts two or three hours. The board told the brothers they could return in three years and ask for parole again. So what's next? One year after the hearings this August 2026, the CPB will conduct what's called an "administrative review" to determine if the brothers can reapply for parole sooner than three years. Both brothers are working on replies to the commissioners to some of the issues raised during their hearings. If the parole board does not set a new date after the administrative review by the CPB, the defense attorneys can petition to apply for an "advanced date" that could set their next hearings in late 2026 or early 2027. Besides being resentenced to 50 years to life from LWOP in May 2025 making them immediately eligible for parole, Erik and Lyle Menendez both qualify for release under California's "youthful offender" status which was part of new state laws passed over ten years ago since they were under the age of 26 at the time of their crime.
