نجح فريق مكتب ميسان للمحاماة والاستشارات القانونية في الحصول على حكم نهائي لصالح أحد الأطباء في قضية اتهامه بالقتل الخطأ على خلفية التعامل مع حالة طبية، وذلك بعد أن أيدت محكمة التمييز الحكم الصادر من محكمة الاستئناف بإلغاء حكم الحبس الصادر بحقه. وتعود تفاصيل القضية إلى شكوى قُدمت ضد الطبيب عقب وفاة مريض أثناء تلقيه الرعاية الطبية، حيث وُجهت إليه اتهامات بالتسبب في الوفاة نتيجة خطأ مهني. وكانت محكمة أول درجة قد نظرت الدعوى وأصدرت حكمًا بحبس الطبيب لمدة سنة، معتبرة أن الواقعة تشكل خطأ أدى إلى وفاة المريض. إلا أن فريق الدفاع من مكتب ميسان، بقيادة الشريكين الأستاذ وليد التتان والدكتور طارق دياب، وعضوية المحاميين يوسف الحسينان وعلي السعيد، تولى الطعن على الحكم أمام محكمة الاستئناف، حيث قدم دفوعه القانونية والفنية مدعومة بالتقارير الطبية وآراء اللجان المختصة، ليصدر حكم الاستئناف بإلغاء حكم الحبس والقضاء ببراءة الطبيب من التهمة المنسوبة إليه. ولم يتوقف مسار القضية عند هذا الحد، إذ تم الطعن على حكم الاستئناف أمام محكمة التمييز، إلا أن المحكمة وبعد نظر الطعن ومراجعة حيثيات الحكم الصادر من محكمة الاستئناف، أصدرت حكمها النهائي بتأييد قرار الإلغاء، ليصبح الحكم ببراءة الطبيب نهائيًا وباتًا. ويُعد هذا الحكم محطة مهمة تؤكد أهمية التدقيق في القضايا الطبية التي تتطلب تقييمًا فنيًا دقيقًا لطبيعة الممارسة الطبية وحدود المسؤولية المهنية، كما يعكس الجهود القانونية التي بذلها فريق مكتب ميسان للمحاماة والاستشارات القانونية بقيادة الشريكين الأستاذ وليد التتان والدكتور طارق دياب، وبمشاركة المحاميين يوسف الحسينان وعلي السعيد، في إدارة ملف القضية حتى صدور الحكم.
