Today, the @fairwork_gov_au decided that personal care workers working in aged care will receive pay increases of up to 28.5%, depending on their classification. These pay increases have been awarded after a long and hard-fought battle led by the @HSUNational to ensure that aged care workers secure the pay rates they deserve. The decision seeks to rectify the gendered undervaluation of the workforce, which has been ignored for too long. Maurice Blackburn is deeply honoured to have partnered with the HSU to achieve this result. The historic pay increases will improve the standard of care in the sector, which is vitally important in ensuring that all Australians are afforded dignity in old age. #EmploymentLaw

NDAs are not standard clauses. A dynamic discussion about the research revealed a need for better advocacy in negotiations, with further legal professional guidance being seen as necessary to shift the traditional mindset that NDAs are non-negotiable.

Last night I had the pleasure of speaking on a panel at the launch of the research report completed by Sharmilla Bargon and Regina Fetherstone - 'Let's talk about confidentiality: NDA use in sexual harassment settlements since the Respect@Work Report.'

It was also common ground that the positive duty to prevent sexual harassment promotes transparency and is likely to transform how organisations set their corporate policies around the use and negotiation of strict NDAs.

Our client confronted a lengthy and hard-fought trial. These findings call into question the Commonwealth’s defence of this litigation and whether it has complied with its obligation to act as a model litigant.
