It costs hundreds of thousands of dollars for cloud storage alone each year and many departments simply don’t have the budget. crimes don’t need to be video recorded to be true. Noonan shot Kelsey because he didn't want to be held accountable for leaving her alone to kill herself. Then he lied about the reason for shooting her so he wouldn't be held accountable for shooting her. Nobody will ever be able to convince me otherwise.

@j3nnyb00m Why didn’t the defense call them? It’s a simple straight forward assault DW. This should have been a 1 maybe 2 day trial to begin with. No need to call witnesses to testify to the same thing over and over again. If their testimony was exculpatory, Bradl would have called them.

@MafiaMasshole @BradlLawPC This was mind blowing to me especially because he knew the Commonwealth had significant impeachment material to show her bias. No reasonable attorney would have ever put this person on the stand. She offered nothing substantive and only hurt the defense.

@graysp_ace They have a lot of sympathy for her. The district attorneys office even offered to negotiate a plea offer with Bradl that would have resulted in not being indicted. Instead Bradl thought a PR campaign disparaging and blaming everyone else was a better strategy.

why do zero of the CW witnesses have any sympathy for what Kelsey went thru? like regardless of what they believe she did, she was having a mental breakdown and she got shot.

@TuesdayGazette Most criminal cases are based on eyewitness testimony as the only evidence at trial. It’s ridiculous to think a crime has to be on video to be true. Unless you can produce evidence of a motive to fabricate, just claiming the complainant is lying is a weak defense.

The Kelsey Fitzsimmon’s case really comes down to a he-said/she-said situation. Their stories are completely different. 👉Officer Noonan describes Kelsey in a sitting position before lunging toward the gun (that’s presumed to be in a shoebox on top of a trunk behind a doorway) and pulling it out at him. 👉Kelsey describes that Noonan wasn’t even in the room when she ran to a trunk and opened it up, pulled out a shoebox, and then lifted the gun to her temple. (I thought there would be more ballistics regarding the angle of the shot from the defense. Maybe that’s still coming?) 👉Kelsey felt like her world was over in that moment. She had been stripped of her child, a broken engagement, and felt betrayed by friends. Anyone with a heart can understand that she was in pain. The problem here is… 👉A suicidal person is not immune from homicidal efforts if they are impulsively reacting in the moment. Murder-suicides happen all the time unfortunately, and so do suicides-by-cop. The rational decision-making can go out the window when emotions are so heightened and a person feels like their world is over. 👉Officer Noonan has no gain from shooting Kelsey if she was trying to shoot herself. No emotional gain, no physical gain. Nothing. The motive is not there. The only reason he would potentially lie is if he accidentally responded to her holding a gun at herself by shooting her as well. Other things that hold weight: 👉Kelsey was showing aggressive and erratic behaviors to her friends and ex fiancé leading up to this date. 👉She allegedly made concerning statements regarding herself and her child. 👉She was recovering from PPD, and had her guns taken away temporarily. 👉 If there is anything that may favor her story of events it would be that she says she did not know that Justin was in the house at that time she is accused of being homicidal. What are your thoughts, guys?

This is the point where, like AJ, Bradl is holding Noonan to his EXACT words to the Grand Jury so he can say “hE LiEd tO tHe gRaND JuRy” and all the small minded people can focus on the “lie” because it wasn’t verbatim.

@Roq9m9 @carriecherry75 @NoAndoverPolice standard. Child was with her and the order granted temporary custody to Justin. Justin also lived at that residence and needed to retrieve property. Standard practice requires police to be present so one party can get their property when an order prohibits contact.

@carriecherry75 @NoAndoverPolice How do you serve a restraining order and then allow the person who asked for the restraining order to show up to the house and go in while the receiver is there? That alone seems like a severe contradiction.

Based on the testimony thus far, it seems like @NoAndoverPolice doesn't think they did anything wrong in serving a restraining order on Kelsey Fitzsimmons, when actually THEY DID EVERYTHING WRONG. It's beyond disgraceful and shameful the way these officers conducted themselves. They failed miserably, and I don't know how these officers sleep at night. Well, strike that. They sleep just fine because in their minds, it was all Kelsey's fault, wasn't it? They're the victims... Is this the standard protocol for regular people, or is this just how they treat one of their own: Why did North Andover Police think it was OK for their department to not only serve a restraining order on a fellow officer but to TAKE HER BABY? How in the world was that not a conflict? Was there no other nearby agency that could handle this? Why didn't North Andover Police immediately secure the guns, since they went in thinking Kelsey was a homicidal maniac capable of shooting her own baby? They should have had an officer remain with Kelsey while they searched the entire house, until all weapons were properly secured and out of her reach. Instead, they blame the "crazy" lady for lying about where the guns were because they didn't do their damn job. Why didn't North Andover Police take someone from social services or a mental health professional? They automatically took Justin Ayalain's word for gospel that Kelsey was "crazy." They also knew that Kelsey had just been on leave for post-partum depression. And yet, their plan was for three burly men to go in, rip her baby from her arms and hand him over to the guy who filed the RO right in front of her face. If she "reacted badly," they'd just put her in a straight-jacket (Section 12 her). Maybe that idiotic plan would have worked out if the officers had properly done the other part of their job - actually secure her damn weapons. Why would North Andover Police call up the guy who filed the restraining order against Kelsey, claiming he was in fear for his life, and invite him over for the show? They willingly brought Justin right into the house (that Kelsey owned) and let him go down in the basement (where Kelsey said the guns were) as they were serving an RO on a woman they believed was an unhinged "whack job" and taking her baby? It didn't occur to any of these geniuses that might escalate an already volatile situation? Why weren't North Andover Police wearing body cams? Surely to God, a police agency like that HAS body cams in this day and age. No? So it's not just in Kelsey's case that we have to take their officers' word, it's in EVERY case? Jesus Christ. What happened on June 30th was preventable. Instead, they nearly got a woman killed. AND THEY DON'T CARE ONE BIT.

Many have significant collateral consequences; losing your home, custody of a child, potentially a job, or worse. 99% of people don’t react the way she did. She clearly was suffering from a significant mental health issue.

There is nothing “routine” about having your 4 month old baby taken from you. Ever. There was nothing routine about your fiancé spearheading it all. The realization of potentially losing her job, her relationship was over, her house, her baby, the life she built and everything else… when people are overcome by emotion they act erratically. Mental health and suicide isn’t black and white but it’s very real. You’re right, there was nothing normal about this… including police response to the situation.

Worst friend award goes to: This bitch. If my best friend was going through what I thought was a mental health crisis, just broke up with her fiancé after a disastrous bachelorette weekend, had recently struggled with PPD and was watching her entire life fall apart - the last thing I would do is side with the boyfriend. ESPECIALLY if I thought a baby was in danger. A real friend would have called her mother or father. Called her. Showed up at the house and HELPED her. But no. This bitch co-signed escalation. She allowed Justin to HURT her friend instead of helping her. This is not a friend. This is a cunt. She proved that by her demeanor in court today. Your best friend was shot and almost DIED. She spent months in jail. She hasn’t seen her baby in almost a year. She lost her job. Her fiancé. Her “friends”. Everything. And you have the audacity to sit there smirking and copping an attitude? @FreeKarenRead3 I don’t know about that. Noonan testified better than probably 80% of cops. I don’t necessarily blame Bradl. He doesn’t have much to work with. His whole theory is the story is fabricated to cover for Noonan over-reacted. He’s not going to get that out of any of these witnesses.

@VickieE0412 @DoctorTurtleboy @LamarVsAllen The pipeline for 18X is basic training/infantry school (OSUT), airborne school, Special Forces Prep Course (SFPC) and then selection. It has a very very low success rate and most don’t make it past SFPC. Usually if a candidate fails out of SFPC they go to a line infantry unit.

@VickieE0412 @DoctorTurtleboy @LamarVsAllen Sorry yes 18x. I’ve been out for awhile. 11x is 11B/11C contract that allows for potential Ranger/RIP contract or whatever they call it now. But you are 100% correct he had an 18X contract allowing him to go through selection if he completed the SF prep course.

@MafiaMasshole That’s really the crux of this. This whole situation wouldn’t exist if she didn’t pull out a gun. Chances are she would have had, at the very least, some visitation with her child within 2 weeks and likely would have joint custody by now, had she just acted rationally.

What sticks out most to me is that Kelsey, a ful-grown sentient adult, is the one who made the conscious decision to pull out a gun.

@mauiswifter @HaleyLWolfie To me it sounded like he was just making excuses for not wanting to meet her since she was being so persistent and wouldn’t stop . He obviously had gas as he drove to his friends, to the court, to KF house, and back to his house in Stowe.

@VickieE0412 @DoctorTurtleboy @LamarVsAllen It was an 11x contract which is a special forces contract. the Army offered an enlistment contract that allows recruits to enlist with a special forces option. For those that enlist under 11x , after basic/infantry/airborne school they go to a prep course before selection .

Second, the police didn’t witness any child abuse/neglect to report to DCF at that time, and third it’s wholly irrelevant to whether KF pointed the firearm at the cop.

As a police officer, you never serve the affidavit to the person. That is a court matter and should never have any police officer get involved in that. That would only create more of a hostile situation.
