Kyle Rittenhouse self-defense vs. Dalton Eatherly self-defense: are they the same? (Short Summaries)
In the Kyle Rittenhouse case, he allegedly crossed state lines with a weapon during protests/riots, later proven the rifle was in Wisconsin. Should he have been there? Probably not. I’ve always personally said that. But, he wasn’t provoking and he was well within his rights to be there according to the law.
But what occurred with Rittenhouse to justify self-defense was simple: video evidence played a major role in that outcome, especially footage showing:
- Joseph Rosenbaum chasing Rittenhouse before the first shooting
- Rittenhouse falling while fleeing
- Anthony Huber striking him with a skateboard
- Gaige Grosskreutz approaching with a handgun visible
All of these situations show retreat and reasonable cause for self-defense. The aggressors clearly were trying to hurt Rittenhouse or worse, while he was retreating (running) and fell.
Rittenhouse was acquitted as the prosecution failed to persuade the jury with sufficient evidence of unlawful use of self-defense.
From what we know from the courthouse proceedings in the Dalton Eatherly aka ChudtheBuilder case is:
- Dalton approached Joshua Fox initially.
- Sources within the courtroom who viewed the video claim that Dalton walked away after the initial interaction, walked around for a minute, went back over by Fox, Fox got up and a verbal interaction occurred. ***This is provocation and a pivotal moment that, if true, will not justify self-defense***
- Dalton switched his phone (on a selfie stick) to his other hand and got in a bladed stance, reached in his jacket pocket for the gun, and the fight broke out.
- Dalton then fired an estimated seven shots; 3-4 shots hit Joshua Fox during the physical altercation. Others hit nearby buildings/office dwellings.
This is backed by affidavit information, news articles, and testimony/video surveillance presented during the bond hearing this past Thursday.
Dalton was charged with attempted murder, employing a firearm during dangerous felony, aggravated assault and reckless endangerment with a deadly weapon. Joshua Fox has not been charged with anything.
In conclusion, the cases might have some surface relation, but the details of both cases are different, especially in the major parts where Dalton has a very extensive and well-documented history of provoking with hate speech while being armed and he approached Fox initially. It appears by the available details and can be argued that Fox only took Dalton down because he feared for his life when Dalton went to pull his gun out of his jacket. Meanwhile, Rittenhouse was on video literally running away or retreating while being attacked, with 2 of the 3 attackers having weapons (skateboard and a pistol).
In my opinion, there is massive difference between the two given the available information.

@TheBrancaShow Yeah, this is all dog-whistling. He can say it’s not and we’re reading too much into it, but at the end of the day it’s up to a jury to decide whether it’s all a big coincidence that he shot a black man like he said he would or not .

I encourage everybody to ACTUALLY listen to this video (mysteriously clipped, but still, even as is). If you listen, and don't blind yourself to the parts that trigger feminine emotions, this is what you'll hear:
Dalton is simply saying that if a black man comes at him presenting as an imminent unlawful threat of serious bodily injury, he will lawfully defend himself. That may lawfully result in that aggressor's death.
That's literally what the law allows for ANY of us faced with any aggressor presenting as an imminent unlawful threat of serious bodily injury. We are allowed to lawfully defend ourselves against such a threat, even at the cost of the aggressor's life.
THAT IS SIMPLY THE LAW.
There's nothing unlawful about any of this, not Dalton's speech, and not his actual conduct when it turned out that he was actually faced with a black man, Joshua Fox, actually presenting as an imminent unlawful threat of serious bodily injury, and Dalton was compelled to defend himself.

As a lawyer following this Dalton Easterly prosecution, I don't see any legal basis for the judge to deny the Duel bond money--the funds are not illicitly acquired, which would be the only basis to exclude them.
Everyone involved in these proceedings--the judge, the prosecutor, the defense attorney--all KNOW THIS. The state is just demanding a source hearing, and the judge is going along with it, purely as a delay and harassment technique against Dalton.
