@Grunzender Enten (auch im Stadtpark) sind herrenlose Wildtiere i.S.d. §960 BGB. Eine Aneignung nach §958 BGB scheitert aber an dem gesetzlichen Verbot des §39 BNatSchG (§958 II BGB). Da Enten nicht besonders geschützt sind, wäre die Mitnahme eine Ordnungswidrigkeit nach §69BNatSchG.

@SuperVegito70 @Grunzender Tut mir Leid, aber das ist so einfach falsch. Enten (auch im Stadtpark) sind herrenlose Wildtiere i.S.d. §960 BGB. Die Sache ist damit nicht "fremd" und Diebstahl scheidet damit aus. Es ist aber eine OWi nach §§39,69 BNatSchG (da nicht bes. geschützt).

@Grunzender Rein rechtlich werden Tiere als „Sache“ behandelt und das Mitnehmen oder die Wegnahme einer fremden, beweglichen Sache wird als Diebstahl bezeichnet. § 242 StGB Da sie auch NICHT DIR gehören, ist das Diebstahl und du kannst von der Stadt dafür belangt werden.
