It's not a defense to battery; what you're missing is this would never meet the criteria for battery. It's saying if you used that consent to actually batter someone the consent doesn't shield you.
The law system is full of common sense checks and balances, case law, the DA would drop the charges immediately after seeing this video if they even brought them at all.

Under your logic, you can go door to door at your college and say "kiss or slap", then call the police and press charges for assault. He's more likely to get hit with misuse of process or it gets dropped on grounds of malicious prosecution because he's using the judicial system to harass, get back at, ... to "win" the argument and farm content for money. His comments immediately after clearly show vexatious intent.
