International law does not provide space for selective application based on political context.
Treaty law relies on clear standards consent, ratification, and legal certainty. Where these are applied inconsistently, legal principles risk becoming political instruments.
In 1960, the so called union between Somaliland and Somalia was driven by political intent, but not clearly formalized through a mutually ratified treaty of union between both sovereign states.
Early developments further exposed these weaknesses. In the 1961 constitutional referendum, Somaliland recorded significant rejection by popular vote, reflecting clear opposition to the union’s terms as implemented. Somaliland officers also sought to withdraw from the union, culminating in an attempted coup.
These events demonstrate that consent was not fully consolidated from the outset.
The failure to address these legal inconsistencies and the continued reliance on a politically sustained rather than clearly ratified union contributed to long-term tensions. It is widely seen as a precursor to the conflict that followed, including the Somaliland War of Independence and the eventual restoration of Somaliland’s sovereignty in 1991.
If foundational issues of consent and treaty law are left unresolved, they do not disappear they evolve into deeper instability and can have broader international consequences, including raising uncertainty around how agreements and borders are upheld in Africa and elsewhere.
Consistency is what gives international law its authority. Without it, the protections underpinning sovereignty and territorial integrity risk being weakened.
