Amicus win from the PA Supreme Court in Erie Insurance Co. v. Heater (WCAB) 🏛️ The Court held that a sole owner-employee is not required to notify their insurer within 120 days to qualify for workers’ comp—only their employer, as the statute clearly states. The decision reinforces a straightforward reading of the Workers’ Compensation Act: notice goes to the employer, not the insurer. While insurers raised concerns about limited investigation time in rare one-person business cases, the Court made clear—that’s a matter for the Legislature, not judicial reinterpretation. Last week the Women Trial Lawyers Section held their annual lobby day during Women's History Month to advocate for a state false claims act and a cap on the cost of medical records.
