Poll watchers (appointed by candidates/parties) and State Election Board observers now have full access to watch tabulation, aggregation, verification, and reporting of votes at the Secretary of State’s central office, Election Night Reporting Room, and everywhere results are handled. Georgia law demands it (O.C.G.A. § 21-2-408, etc.), proceedings must be open to the public, and the Court said: no more blocking transparency. The judge nailed it: irreparable harm if denied, public trust is everything (especially when the SoS is running in the election he’s overseeing), and this is zero burden on Raffensperger — Simple. I was AG Paxton’s lawyer during the failed attempt to impeach him. I studied every piece of evidence. I cross examined the key witnesses. It quickly became apparent to me that the entire effort was sloppily thrown together by those he opposed—the old guard, the establishment. Their hope was that with unsupported, salacious allegations, along with a compliant and willing media, Paxton would quit. He would not quit. He will not quit. He will never quit. The totality of the impeachment evidence was nothing more than junk. And it didn’t take much effort to expose it. In the process I came to know Ken Paxton. He is thoughtful, strategic, and brilliant. He will be a damn fine senator for our state. Most of the attacks you see now are being made by the same people he soundly defeated in the impeachment. They lost then, and they will lose again. Texas has a reputation for leading in conservative governance, but we must do more to live up to that reputation. And Texas should never be outdone by Washington, D.C. in fighting waste, fraud, and abuse. We must put Texas taxpayers and patients FIRST! Full letter: Dear Governor Abbott and Executive Commissioner Muth, I write not only as a member of the Texas legislature, but as a former Chief of Staff of the U.S. Department of Health and Human Services during President Trump’s first administration. Last week the Trump Administration announced bold action to combat the ever-increasing fraud within the Medicare system, including a six-month moratorium on new Medicare enrollment for hospices and home health agencies (HHAs). HHAs have long been recognized as the one of the “highest-risk Medicare provider/supplier types in terms of program integrity.” After discovering unusual and highly disturbing trends in HHA enrollment in the Los Angeles region, CMS announced last week that in addition to the moratorium it has taken action to shut down 800 fraudulent providers in Los Angeles. While Los Angeles’s data is especially concerning, CMS has cited blatant examples of fraud throughout the country, including in Texas. The CMS Administrator said during a recent public interview that the bad actors they’re targeting in California may be relocating to Texas. I believe he is likely correct. CMS’s new mortarium is good for Texas taxpayers, because Texas taxpayers also pay federal income taxes, which fund these programs. But the state of Texas can - and must - do even more to protect our taxpayers. As you are aware, the Trump Administration’s moratorium only applies to providers in the Medicare program, which is exclusively a federal program, and not to Medicaid providers, since those are under the purview of the states. Medicaid is rife with fraud. In fact, Paragon Health Institute research indicates that the improper payment rate may be as high as 25%. Texas – and all states – should take similar actions in our Medicaid program. Therefore, I am respectfully requesting you take all actions necessary to effectuate an immediate freeze on new applications for hospice and HHAs in the Texas Medicaid program. This would combat fraud, protect taxpayers and patients, and thwart any bad actors in California that may be in the process of moving to Texas. Further, during the pendency of this moratorium I ask that you conduct a thorough examination of potential fraud in our program to inform both the executive branch and the legislative branch as to whether this moratorium should be extended.
