Frequently, college athletes get sucked into the thinking that the most important factor is getting the biggest NIL deal possible, which leads them to neglect all of the other (arguably) more important factors that should go into an athlete's assessment when deciding where to continue their athletic and academic careers, factors like: ✅ athletic circumstances, like opportunities for meaningful playing time and ability to advance to the professional ranks ✅ the terms and conditions of the NIL/revenue-share agreements and how the provisions impact the athlete's interests and future ✅ academic opportunities, like access to preferred majors, academic prestige, and whether credits will transfer ✅ the state and federal income tax implications of the NIL deals Yet, so many college athletes and the "street agents" advising them become transfixed with this one factor, oftentimes at the expense of the athlete and their future. Athletes shouldn't be sacrificing what's in their long-term best interest in favor of maximizing the commission check and profit of their unqualified, underhanded representative in the short-term. Athletes are in dire need of selfless representatives, agents who are willing to help them not only navigate the ever-changing landscape of college sports, but also take steps to protect their interests and safeguard their futures. They need experienced, knowledgable, and trustworthy representatives with the legal expertise to guide them towards long-term success, and the stakes are too high to allow an athlete to entrust their future to one of these self-interested "street agents" who care more about themselves and their bottom line than the athletes they claim to represent. Unfortunately, I see it almost daily: the college athletes that are advised by "street agents" frequently become fixated with the numbers being thrown around and 'guaranteed' in their Name, Image and Likeness ("NIL") and revenue-share agreements. By focusing on getting the 'biggest' NIL deals, the athletes oftentimes overlook what happens after the agreements are signed, all because the unqualified, inexperienced "street agents" advising the athletes care more about lining their own pockets than protecting the very athletes they claim to represent. Frequently, this results in the athlete's NIL revenue trumping all of the other (arguably) more important factors that should go into an athlete's assessment when deciding where to continue their athletic and academic careers, factors like: ✅ athletic circumstances, like opportunities for meaningful playing time and ability to advance to the professional ranks ✅ the terms and conditions of the NIL/revenue-share agreements and how the provisions impact the athlete's interests and future ✅ academic opportunities, like access to preferred majors, academic prestige, and whether credits will transfer ✅ the state and federal income tax implications of the NIL deals All that to say, the total contract value of an NIL deal may be an important aspect of the evaluation process, but it is far from the only one. Yet, so many college athletes and the "street agents" advising them become transfixed with this one factor, which regularly results in the athlete sacrificing what's in their best interest in the long-term in favor of maximizing their unqualified, underhanded representative's profit in the short-term. Athletes are in dire need of selfless representatives to help them not only navigate the ever-changing landscape of college sports, but also look out for their futures and take steps to protect their interests and safeguard their futures. They need experienced, knowledgable, and trustworthy representatives with the legal expertise to guide them towards long-term success. Like the many recent challenges to #NCAA eligibility rules (or lack thereof), the NCAA's attempt to rein in college athlete Name, Image and Likeness (NIL) compensation through the College Sports Commission (CSC) and its clearinghouse, NIL Go, is facing widespread legal scrutiny. But first, what is the CSC? What about NIL Go? Arising from the post-House v. NCAA settlement framework, the CSC was created, in part, to address the NCAA's concerns around unvetted #NIL deals. Shortly thereafter, NIL Go, the CSC’s Deloitte-operated clearinghouse, was created with a mandate of ensuring the 'legitimacy' of NIL deals by reviewing all third-party NIL deals over $600. For the uninitiated, NIL Go may sound like a silver bullet in the NCAA's quest to ‘save college sports.’ In practice, however, NIL Go has brought further scrutiny and stirred more doubt as to the future of college athletics and the NCAA’s role in that future. According to the reporting of @RossDellenger, the CSC has outright denied nearly $15 million in deals submitted to NIL Go for reasons that include: ➡️ Lack of ‘legitimate business interests’ ➡️ “Warehousing” NIL Rights by signing deals contingent upon future events ➡️ Compensation exceeding the ‘fair market value' of NIL rights While the reasons for rejecting an NIL deal may vary, each rejection often amounts to nothing more than the use of subjective standards to ensure that the CSC, rather than the free market, has final say over college athlete compensation. What's more, with only a handful of individuals at NIL Go reviewing the massive volume of NIL deals, when deals aren't outright rejected, athletes are often held hostage by the process, leading to athletes experiencing: ▪️ Cash-flow delays ▪️ Lost or renegotiated deals ▪️ Uncertainty In short, despite being sold as a way to protect college athletes, NIL Go instead harms athletes, many of whom are unequipped and unprepared to confront alone and are inundated with messages from unqualified “street agents” that are only interested in lining their own pockets. Athletes deserve better than this inaccessible, unfair system created by the CSC. They deserve better than being abandoned to navigate this process alone, and the stakes are too high to allow self-interested representatives to exploit the athletes they claim to represent. Athletes deserve experienced, knowledgable, and trustworthy representatives. They deserve agents with the legal expertise to help them navigate the pitfalls of college athletics and guide them towards long-term success. Completely agree with @Pat_CurranMedia and his thoughts on the ongoing crisis of so-called ‘Street Agents’ exploiting college athletes and the need for a college football player’s association!! However, many legal hurdles and roadblocks stand in the way of forming of a CFB PA at the moment, meaning we need to take actionable steps in the interim to tackle this crisis head-on. With the rise in Name, Image and Likeness (NIL) college athlete compensation, the Transfer Portal, NIL collectives and revenue-sharing, college sports has been a source of constant change over the past few years. This ever-shifting landscape has opened the floodgates to unqualified, underhanded individuals looking to score an easy payday by taking advantage of the chaos. Most of these “street agents” take on athletes without truly understanding the inner workings of intercollegiate sports, let alone the legal skills necessary to properly represent college athletes.  However, that has not stopped these bad actors from flooding onto campuses and into DMs to sell guarantees of seven-figure deals and fast tracks to professional sports. As a sports agent and attorney, I hear the horror stories: ▪️ Agents taking upwards of 45% of all athlete compensation (true story) ▪️ Agents advising athletes on NIL agreements without any legal training, much less the legal expertise to protect an athlete and his future ▪️ Athletes signing away rights and locking themselves into unfavorable deals ▪️ Agents operating in states without proper licensing ▪️ Agents pressuring athletes to enter the transfer portal In short, these “street agents” are exploiting not only the chaos in college athletics but the athletes themselves. Athletes deserve better than these self-interested representatives, and coaches across the country are rightfully sounding the alarm on the rapid growth of these bad actors. Confronting this crisis is long overdue. However, we cannot combat these parasitic street agents by vilifying all agents–such condemnations will only reduce the guidance available to the very athletes in need–but must, instead, counter their prevalence by calling for experienced, knowledgable, trustworthy and integrity-driven representatives who prioritize the athletes’ interests above all else.
