@RelicCcb I don’t see how it could be unconstitutional; more importantly, it’s far too late in the day for this to be considered an open question. It would be like calling into question the validity of the ratification of the 14th amendment.

In general, the problem with all the recent talk of “viewpoint diversity” as the cure for the monoculture of the university is this: (1) everyone thinks that there must be some limits of professional competence to viewpoint diversity (no flat-earth types in the geography department please); (2) academic progressives overwhelmingly hold that views like “men cannot get pregnant” are as inadmissible as believing in a flat earth. Hence they are ultimately unable to reform themselves, at least at the department level. There must be thorough reconstruction from above or from outside.

If we were willing to get rid of VRA districts, coming up with judicially manageable standards for combatting gerrymandering would be a lot easier. But if we have to keep VRA districts, I don’t see how you can implement anything like a mechanical rule.

In order to “ban gerrymandering,” you need to be able to define gerrymandering—which isn’t easy. It would be better to specify a mechanical rule on the basis on which districts are to be drawn (though this means abandoning VRA districts).
