With this, the legal basis has been established for new criminal justice bodies that will separately handle indictment and investigation of serious crimes, replacing the Prosecutor's Office, which is set to disappear into history following the amendment of the Government Organization Act. The National Assembly passed the Serious Crimes Investigation Agency Act at a plenary session on this day with 166 votes in favor and 1 against, out of 167 members present. The dissenting vote was cast by Representative Lee Joo-young of the New Reform Party. According to the bill, the Serious Crimes Investigation Agency will be established as an agency under the Minister of the Interior and Safety, and its primary targets for investigation are six major crimes: corruption, economic crimes, defense industry crimes, narcotics crimes, insurrection and foreign exchange crimes, and cybercrime. Cases involving so-called "distortion of justice," as well as crimes committed while in office by officials from the Prosecution Service, the police, the Corruption Investigation Office for High-ranking Officials (CIO), and the courts, are also included within the scope of the Serious Crimes Investigation Agency's investigation. Investigators at the Serious Crimes Investigation Agency are classified as "special-category" civil servants and operate under a single rank system ranging from Grade 1 to Grade 9. While open recruitment is the principle, the bill allows for career recruitment limited to those with relevant academic knowledge, experience, technical skills, or research achievements. The government's original draft of this law included a provision requiring the Serious Crimes Investigation Agency to notify the Prosecution Service when initiating an investigation; however, the Democratic Party removed this clause following discussions among the party, the government, and the Blue House. Previously, the National Assembly passed the Prosecution Service Act at a plenary session the previous day, which stipulates the organizational structure of the Prosecution Service and the authority of its prosecutors. The core of the bill is that the Prosecution Service will exclusively handle prosecution in accordance with the principle of separating investigation and prosecution, and will operate under a three-tiered system consisting of the Prosecution Service, Metropolitan Prosecution Service, and Local Prosecution Service. The existing prosecution's authority to command and supervise special judicial police officers has been abolished, and a new clause prohibiting "abuse of power" has been established. Furthermore, by explicitly designating "dismissal" as a ground for disciplinary action against prosecutors, the bill makes it possible to dismiss a prosecutor without impeachment proceedings. The People Power Party reacted with a filibuster (legal obstruction of parliamentary proceedings through unlimited debate), protesting that it amounted to "the destruction of the prosecution" and "the worst amendment." However, in accordance with relevant laws, the Democratic Party, along with progressive minor parties, concluded the debate by vote after the 24-hour filibuster period had passed and subsequently passed the bills in sequence. Immediately after the passage of the Serious Crimes Investigation Agency Act, Democratic Party Leader Chung Cheong-rae wrote on Facebook, "A 70-year-old long-cherished project is being completed," adding, "Thank you, citizens. Thank you, President Lee Jae-myung." Baek Seung-ah, the party's floor spokesperson, issued a statement saying, "The era of prosecutorial dictatorship that reigned over the people is now disappearing into history," and added, "The Democratic Party will actively support the stable establishment of the Prosecution Service and the Serious Crimes Investigation Agency, and will push forward with the remaining reform tasks without wavering." With the completion of legislative procedures for the Indictment Agency and Serious Crimes Investigation Agency Acts, the Democratic Party plans to continue its self-proclaimed prosecution reform efforts after the June local elections by processing amendments to the Criminal Procedure Act and other bills. Regarding the amendment to the Criminal Procedure Act, the key issue within the party is whether to grant supplementary investigative powers to prosecutors at the Indictment Agency. While President Lee has stated that exceptional supplementary investigative powers are necessary, hardliners within the party argue that such powers should not be permitted. Meanwhile, the plan for the so-called "National Investigation into Allegations of Fabricated Indictments by the Prosecution During the Yoon Suk-yeol Administration," which is being pushed by the Democratic Party, was submitted to the plenary session today. This has been difficult since much of the process is managed by NGO's not subject to FOIA requests. AI tools have enabled me to make a breakthrough.
