• สภาผู้แทนฯ เห็นชอบ ยกเลิกคำสั่ง คสช.ที่ 14/2559 คืนอำนาจประชาชน ให้มีส่วนร่วมกำหนดการบริหารชายแดนใต้ • จาตุรนต์ ฉายแสง @chaturon สส.บัญชีรายชื่อ ในฐานะประธานคณะกรรมาธิการวิสามัญพิจารณาร่างพระราชบัญญ้ติยกเลิกคำสั่งคสช. ที่ 14/2559 เรื่อง สภาที่ปรึกษาจังหวัดชายแดนภาคใต้และการกำหนดอำนาจหน้าที่ของ กอ.รมน.ฯ นพ.เชิดชัย ตันติศิรินทร์ สส.บัญชีรายชื่อ อภิปรายร่างพระราชบัญญัติยกเลิกคำสั่งหัวหน้า คสชฯ ว่า ▪️การพิจารณาร่างพระราชบัญญัติ เพื่อยกเลิกคำสั่ง คสช. ฉบับนี้ จะเป็นการปูทางในการปลดล็อคคำสั่ง คสช.โดยสภาผู้แทนราษฎร เพราะถือเป็นคำสั่งแรกที่ดำเนินการโดยรัฐสภา และเป็นก้าวสำคัญในการแก้ไขปัญหาพื้นที่ชายแดนภาคใต้ที่จะได้ “สภาที่ปรึกษาฯ” กลับคืนมา ▪️ “สภาที่ปรึกษาฯ” นี้จะเป็นกลไกสำคัญที่ให้ประชาชนในพื้นที่มีสิทธิมีเสียงและมีส่วนร่วมในการกำหนดแนวทางการบริหารชายแดนใต้ ▪️คณะกรรมาธิการได้พิจารณาและมีความเห็นว่า เมื่อมีการยกเลิกคำสั่งหัวหน้า คสชฯ มีผลทำให้ 1️⃣คณะกรรมการที่ปรึกษาการบริหารและการพัฒนาจังหวัดชายแดนภาคใต้ ซึ่งแต่งตั้งขึ้นตามคำสั่งดังกล่าวสิ้นสุดลง 2️⃣บรรดาบทบัญญัติแห่งกฎหมาย กฎ ระเบียบ ข้อบังคับ ประกาศ คำสั่ง และมติคณะรัฐมนตรีในส่วนที่อ้างถึงสภาที่ปรึกษาการบริหารและการพัฒนาจังหวัดชายแดนภาคใต้ และประธานสภาที่ปรึกษาการบริหารและการพัฒนาจังหวัดชายแดนภาคใต้ ซึ่งถูกงดใช้บังคับโดยคำสั่งดังกล่าวกลับมามีผลใช้บังคับเช่นเดิม อ่านต่อ facebook.com/10004456974364…

Pheu Thai list MP Chaturon Chaisang has warned that the referendum law needs to be amended to eliminate the double majority rule, aiming to prevent a deadlock in the charter amendment process. Chaturon suggested that the amendment of the referendum law could be carried out simultaneously with the push for a bill to amend Section 256. This bill aims to establish a charter drafting assembly for the constitution's rewriting without the necessity of an initial referendum. The objective is to reduce the number of required referendums for charter rewriting from 3 to 2. Chaturon noted that Parliament has encountered a similar situation in the past, specifically during the previous administration when the former House Speaker postponed the bill's deliberation until the dissolution of the house. This delay was driven by concerns that proceeding with the bill might violate the Constitutional Court's March 2021 ruling. The court ruled that Parliament possesses the authority and duty to draft a new constitution but emphasized the requirement for two referendums. The initial referendum is for the public to vote on their preference for a new constitution. The second occurs after the draft constitution is completed, involving a vote on whether to accept or reject the proposed constitution. Chaturon emphasized that the current government faces a comparable predicament, necessitating seeking the court's ruling on whether amending Section 256 would violate the charter. However, uncertainty exists regarding whether the court will accept the petition. Deputy Prime Minister Phumtham Wechayachai declared earlier this week that the government will persist in proposing the three-referendum method in Parliament. This approach allows them to seek the Constitutional Court's ruling on amending Section 256 to proceed with the two-referendum approach. He explained that the government cannot approach the court before presenting its proposal in Parliament, as the court will not entertain it. Chaturon said that if a referendum has to be conducted now, it will adhere to the current referendum law, which requires a double majority. This method, where more than 50% of eligible voters must participate, and a majority of those who cast votes must approve it, could impede the rewriting of the charter by a charter drafting committee for an extended period, possibly indefinitely.
