तमिलनाडु के गवर्नर ने TVK के थलपति विजय को कहा है कि जब तक वो 118 विधायकों के समर्थन की लिस्ट नहीं देंगे, सरकार बनाने का निमंत्रण नहीं मिलेगा। ऐसी शर्त रखते हुए गवर्नर minority government के प्रावधान को नकार रहे हैं। केंद्र में प्रधानमंत्री पीवी नरसिंह राव की सरकार पूरे पाँच साल अल्पमत की सरकार थी। क्या वो वैधानिक /लीगल सरकार नहीं थी? प्रदेशों में भी कई minority government बनी हैं। दरअसल एक MP या MLA के पास वोटिंग के तीन विकल्प होते हैं: yes, no, abstain उन्हें abstain या वोट न डालने के फैसले का भी हक है। गवर्नर इस अधिकार को नकार नहीं सकते हैं। इस अधिकार के चलते ही confidence motion या विश्वास मत का नियम कहता है कि सदन में मौजूद सदस्यों का बहुमत चाहिए। सदन की कुल संख्या का बहुमत ज़रूरी नहीं है। अर्थात, अगर सदन की कुल संख्या 200 है और केवल 180 ‘हाँ या ना’ का वोट डालते हैं, तो विश्वास मत जीतने के लिए 101 नहीं, सिर्फ़ 91 वोट चाहिए होंगे। इसीलिए गवर्नर का यह कहना ग़लत है कि पहले 118 सदस्यों के समर्थन की लिस्ट उन्हें मिलेगी, तभी वो सरकार बनाने का न्यौता देंगे। TVK सबसे बड़ा दल है। कोई दूसरा दल दावा पेश नहीं कर रहा है। इसलिए उसे सरकार बनाने का निमंत्रण मिलना चाहिए और बहुमत सदन में साबित करने का अवसर मिलना चाहिए। संभव है कि कोई पार्टी या कोई सदस्य abstain का विकल्प चुनें और वोट न देने का फ़ैसला करें। तब 118 के समर्थन की कोई ज़रूरत नहीं होगी और @actorvijay थलपति विजय अल्पमत की सरकार चला सकते हैं। उनका ये अधिकार गवर्नर नहीं छीन सकते हैं। पहले के गवर्नर समर्थकों की पूरी लिस्ट न होने के बावजूद न्यौता देते रहे हैं। सबूत के तौर पर 16 मई, 2018 की कर्नाटक राज्यपाल की चिट्ठी देख सकते हैं, जिसमें बीजेपी के येदियुरप्पा को संख्या बल न होने के बावजूद सरकार बनाने का निमंत्रण मिला था। @INCIndia @kharge @RahulGandhi
