Case in point. States are trying to override what Congress decided 50 years ago. AG Kaul isn't protecting Wisconsin consumers – he's trying to block them from federally regulated markets that Congress explicitly authorized the CFTC to oversee.
Matt Smith@mattsmith_news

"Ultimately, they're suing based on a fundamental misunderstanding." Ryan VanGrack, VP of legal and head of litigation for Coinbase, on AG Kaul suing major prediction markets like Coinbase and Kalshi: "He's wrong because Congress already answered this question long ago."

Prediction markets must be transparent, fair and well-regulated. That’s why we need to keep these markets here in America under the jurisdiction of the @CFTC.

Today’s amicus brief represents the @CFTC’s continued effort to protect our jurisdiction over prediction markets from the ongoing campaign of state encroachment. As I’ve said repeatedly, the agency will not allow overzealous state governments to undermine our longstanding authority over these markets. Read more⬇️

In 1944, the collective wisdom of individuals with skin in the game beat 118 professional political writers at predicting the election. This happened without scientific polling, modern data infrastructure, and limited national information flow. Since then, the world hasn't gotten simpler. Market prices don't move on one thing anymore — they move on everything, all at once, across the entire world. No analyst, model, or poll captures all of it. Prediction markets gather the wisdom of crowds to provide unique insights.

“The statute says in very plain text that the CFTC has exclusive jurisdiction over all derivatives. That’s black-letter basics.”

The @WSJ knew what they wanted to say. Then they went looking for selective data to say it. ✔️ Misleading headline ✔️Burying data contradicting the headline ✔️Unrepresentative sample ✔️Narrowest possible slice of platform activity used to indict the whole thing
The Wall Street Journal@WSJ

A WSJ analysis found 67% of Polymarket profits goes to just 0.1% of accounts, while most traders are in the red. Most Kalshi users also lose money. on.wsj.com/4td9UPy

Insider trading will not be tolerated. The @CFTC will use the full force of the law to protect market integrity for the American people and those who misappropriate information on our markets should be on notice. Watch more with @SaraEisen on @CNBC 📺

Great to see this being taken seriously. Worth clarifying, though, federal law already prohibits trading on material nonpublic information (MNPI) if you obtained it through fraud or deception, or got it through a position of trust. That includes political insiders.

We’ve said it before. We’ll say it again: We have a proven regulator at the @CFTC to set clear standards, run a transparent rulemaking process, and enforce the rules so these markets stay fair and trustworthy here in the U.S. A confusing state-by-state patchwork doesn't protect consumers. Neither do bans that just push users to unregulated venues. Federal oversight does.
CBS News@CBSNews

Just how fair prediction markets are now depends partly on the trading venue. cbsn.ws/4udtoEt
