Party Register Law Unconstitutional, Should Be in INEC Guidelines, Not Electoral Act – Maduabuchi
INEC was set up by the Constitution and given specific powers to organise, undertake, and supervise elections. Removing any of these powers amounts to amending the Constitution. In effect, INEC cannot be told how to run an election. Section 29(1) of the 2026 Electoral Act is therefore unconstitutional because it directs INEC on what to do, which contradicts the constitutional design.
