CAN YOU BE ARRESTED OVER UNPAID LOANS?
Someone lends you money or you were granted a loan, but, when it's due for payment, you can't meet up with the pay due to one reason or the other.
Your failure or refusing to repay the loan is NOT automatically a criminal offence.
It is a purely civil matter, which is a simple breach of agreement.
Section 36 (12) of the Constitution of the Federal Republic of Nigeria 1999 (as amended), which ensures no one is punished for something that is not defined as a crime by law.
The lender shall take the following steps:
* Make a formal demand for payment
* Take the debtor to court since he refuses to pay.
* Lead credible evidence and establish the loan
* Get a judgment
* Enforce it legally through lawful means (e.g., garnishee, seizure of assets)
The idea of using police to recover ordinary debt is illegal and an abuse of power. It is never in the duty of police to arrest on debt matter.
If there is no criminal elements in a case, there should be no arrest or detention by any Law Enforcement Agent.
It only becomes a criminal offence if you obtained the money through:
* Fraud or false pretense.
* False pretence
* Fake documents or identity
* Issuing a cheque you know will bounce.
* Took loan with intent to dissappear.
If the above happens, then, it’s not ordinary “debt”, it’s CRIME.
You cannot be arrested just because you owe money. But you can be arrested if you lied to get it.
If anyone threatens you over a loan debt, report to the appropriate authority.

The Nigerian Communications Commission @NgComCommission thinks it could mislead Nigerians by endorsing superficial remedies instead of insisting on meaningful reforms.
Advising @MTNNG and other criminal extortionist telecom operators to offer token “freebies” in place of real accountability does nothing but think it could mislead Nigerians by endorsing superficial remedies rather than addressing the systemic exploitation subscribers face daily, from unexplained data depletion to persistent service failures that amount to outright consumer abuse and exploitation.
Nigerians are not asking for handouts; they are demanding standards, transparent billing, reliable connectivity, and services that meet internationally accepted benchmarks. Anything short of that is an insult to millions who pay dearly for substandard service.
The telecom operators must, within 7 DAYS from today, overhaul their practices and deliver the quality Nigerians deserve. Equally, the regulatory authorities and those responsible for oversight must be held accountable for enabling the Minister of Communications and the loafers at @NgComCommission must address these issues urgently, otherwise they will face the wrath of subscribers the same way the telcos led by @MTNNG are bound to be disgraced in the coming days. #OCCUPYMTN #AACOurParty

We must #OccupyMTN. The exploitation of Nigerians by telecom operators can no longer be tolerated. While @MTNNG stands out for its dominant market share, it is not alone; @AirtelNigeria, @GloWorld, and @9mobile are also implicated in practices that shortchange subscribers. Nigerians deserve fair value, reliable service, and accountability from every operator, including the loafers @NgComCommission and @bosuntijani, Nigeria's Minister of Communications.
