Adult Woman Free to Choose Partner: Madhya Pradesh High Court Rejects Husband’s Plea to Bring Pregnant Wife Back The Madhya Pradesh High Court has held that an adult woman’s choice and autonomy must be respected, even in matrimonial disputes, while dismissing a habeas corpus petition filed by a husband seeking custody of his wife. The Court observed that when a major woman voluntarily chooses not to live with her husband and is not under illegal confinement, no relief can be granted in habeas corpus proceedings. The matter came before the Court after the husband alleged that his wife was being illegally detained by another man. However, when produced before the bench, the woman clearly stated that she was residing with the said individual of her own free will and did not wish to return to her husband. She further informed the Court that her marriage had been arranged against her wishes and that she had been living separately since February 2026 by choice. The husband submitted that his wife was six months pregnant and expressed willingness to take her back, but the woman declined. Taking note of her statement, the Court held that there was no case of illegal detention and that her personal liberty could not be curtailed. At the same time, the Court observed that since the marriage still subsists, the appropriate course would be either reconciliation or seeking divorce as per law, and directed the parties to explore mediation and counselling. Finding no merit in the plea, the Court disposed of the petition, reaffirming that an adult woman is free to decide where and with whom she wishes to live.
