Plaintiffs increasingly attempt to recast online editorial decisions as defective product design. In Truth on the Market, @RBenSperry explains how repackaging speech decisions in this way weakens constitutional protections and encourages platforms to restrict expression. 🔗 ⬇️

Good quote from the Supreme Court today that could apply elsewhere as we think about how to regulate online speech platforms: "[S]peech does not become conduct just because the State may call it that"

Taken together, these posts try to think about how to not only protect minors online, but balance the incentives correctly to maximize the benefits of internet usage while recognizing there are costs too. As always, there are no solutions, only tradeoffs

Surprisingly, it is the concurrence from Justice Sotomayor in Cox that seems most cognizant of preserving the incentive structure under the DMCA when it comes to protecting copyrighted works
