The deceptive UNDRIP scheme is unravelling in B.C., by @IndianRevisited open.substack.com/pub/hymie/p/th… Aboriginal law specialist Geoffrey Moyse critiques the B.C. government’s implementation of UNDRIP through DRIPA, an effort that is being challenged in court. The government’s interpretation of DRIPA, which it claims does not create new rights or apply to private land, is disputed by Moyse. He also disputes the government’s approach to implementing UNDRIP, which involves applying its principles as policy despite inconsistencies with Canadian law, as being deceptive and potentially harmful to the province’s economy.

When Do ‘Land Acknowledgements’ End?, by @IndianRevisited open.substack.com/pub/hymie/p/wh… According to the author of the piece below, Jerry Amernic, the Fraser Institute’s study, “An Avalanche of Money: The Federal Government’s Policies Toward First Nations,” reveals a concerning increase in indigenous funding without corresponding improvements in the well-being of aboriginal people. The study also highlights the lack of transparency regarding class-action payouts and trust-fund use. In an excerpt from SLEEPWOKING, a book about historical revisionism in Canada and all the fallout associated with it, Amernic questions the purpose and effectiveness of land acknowledgements, arguing that they perpetuate a narrative of victimhood and fail to recognize the contributions of non-Indigenous Canadians.

Open Letter to Senator Scott Tannas and Senator Margo Greenwood, by @IndianRevisited open.substack.com/pub/hymie/p/op… In this carefully documented must-read piece, an open letter sent to two skeptical members of the Senate Standing Committee on Indigenous Peoples, gifted thinker and researcher Michelle Stirling expresses concern over the lack of evidence supporting claims of mass graves and missing children at Indian Residential Schools. She particularly argues that the Kamloops Indian Band’s claim of finding 215 children’s remains was used to push through the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) without due diligence. She also calls for an inquiry into the Truth and Reconciliation Commission’s omissions, unproven claims, and the dissemination of unvetted reports.

Memorial for Kamloops ‘graves’ takes place at Fort Calgary, by @IndianRevisited open.substack.com/pub/hymie/p/me… According to a news story by Leah Mushet, a memorial for the Tk̓emlúps te Secwépemc children, whose burials were announced in 2021 — but never proven to exist — at a Kamloops residential school, took place at Calgary city hall. The event included a planned relocation of symbolic children’s shoes to The Confluence Historic Site and Parkland, formerly Fort Calgary, where Frances Widdowson, who has rightly questioned the evidence of the graves, was present. While some supported Widdowson’s right to free speech, others criticized her for perpetuating harm against indigenous people for the “crime” of telling the truth about these so-called graves.

BREAKING: Canada Told China about “Mass Grave” Containing the Remains of Indigenous Children, by @IndianRevisited open.substack.com/pub/hymie/p/br… According to the results of a formal “Freedom of Information Request” by Blacklock’s Reporter, Canada’s Foreign Affairs Department engaged in private talks with China, expressing regret over the alleged — but still totally unproven — discovery of graves at the former Kamloops Indian Residential School. The department urged China not to repeat Canada’s so-called past mistakes and to address its own human rights violations against ethnic minorities, particularly Uyghurs in Xinjiang. Despite China’s attempts to deflect criticism by highlighting Canada’s historical treatment of indigenous peoples, a treatment that is still being disputed by people like me, Canada emphasized its commitment to reconciliation and accountability. As for the charge that “Canada is still dealing with the intergenerational harm caused by past assimilationist policies that separated Indigenous children from their parents and placed them in Residential Schools,” readers of this newsletter will know that these assimilationist policies were based on parental consent because parents were obliged to sign an enrolment form if they wanted their children to attend an Indian Residential School. Often, such requests were turned down due to a lack of space or funds to support their placement. Equally important, only orphaned, neglected, abandoned, or abused children were obliged to attend one of these schools to ensure their well-being and survival.

Who really owns Canada?, by @IndianRevisited open.substack.com/pub/hymie/p/wh… No local body or foreign country “owns” Canada. Instead, King Charles III is the legal Head of State, with the Crown (represented by the Governor General), albeit acting as a figurehead in practice, while the Canadian government manages the country. Only about 11% of Canadian land is fee simple property (i.e., “privately” owned), while the remaining 89%, including all Indian Reserves, is “Crown Land.” These facts actually strengthen my position that they apply, or should apply, equally to indigenous and non-indigenous peoples, including those living on Indian Reserves, tracts of Crown land administered by the government of Canada on behalf of both the King of Canada and its indigenous residents.

Inside the minds of Concordia’s anti-Israel activists, by @IndianRevisited open.substack.com/pub/hymie/p/xx… In brief excerpts from his analysis posted below, the National Post’s Terry Newman argues that a talk at Vanier College, organized by the women and gender studies department and featuring two of Montreal’s Concordia University students, devolved into a pro-Palestinian session filled with inaccuracies and extremist rhetoric. The students, Rayana Eltanoukhi and Danna Noor Ballantyne, discussed their activism, claiming to have faced repression from the university and the Israeli Consulate. They falsely claimed that Concordia hired an Israeli security firm to target pro-Palestinian students and that the university banned a student union employee for alleged illicit activity. The SPHR (Solidarity for Palestinian Human Rights) association discussed below is a non-profit, student-based organization that advocates for Palestinian rights, liberation, and self-determination. It was founded in 1999 following a merger of student groups at Concordia and McGill universities in Montreal. SPHR chapters are heavily involved in campus activism, organizing demonstrations, and participating in what they describe as a “global Student Intifada” to challenge the so-called occupation, in truth a disagreement over the ownership of contested land. Similar to the broader Palestine Solidarity Campaign, SPHR supports actions like boycotts, divestment, and sanctions (BDS) to put pressure on Israel. The organization has faced criticism from university administrations, such as McGill, for its rhetoric following the October 7, 2023, attack, with claims that its posts celebrated violence. SPHR has stated that it is focusing on the “prospect of liberation.”

Aaron Gunn says land acknowledgements undermine private property, by @IndianRevisited open.substack.com/pub/hymie/p/aa… Cosmin Dzsurdzsa, Managing Editor, Juno News, reports that Conservative MP Aaron Gunn believes that frequent land acknowledgements by governments threaten private property rights in Canada. He believes these acknowledgements reinforce the idea that land in our sovereign nation was “stolen,” thereby subverting the concept of private property ownership. This sentiment was also echoed by BC Conservative leadership candidate Harman Bhangu, who emphasized the importance of secure property ownership for British Columbians.

Breaking News: Unjustly fired Dr. Frances Widdowson may soon be reinstated to her position at Mount Royal University, by @IndianRevisited open.substack.com/pub/hymie/p/br… Frances Widdowson’s arbitration decision has just been sent back to the arbitrator for reconsideration because he made erroneous and illogical arguments, particularly regarding the untenable nature of her reinstatement. Even if you have no legal training, it is easy to see the contradiction in first claiming that Widdowson was unjustly fired and then stating her reinstatement was untenable.

Why did Ottawa lose the Cowichan case, and how can it win the appeal?, by @IndianRevisited open.substack.com/pub/hymie/p/wh… According to star researcher Nina Green, Ottawa lost the Cowichan case because federal lawyers were restricted from arguing that Aboriginal title in BC was extinguished. The strongest ground for appeal is that Madam Justice Young erred in finding that Governor Douglas intended to mark out a reserve in the Cowichan claim area in 1859. This finding is flawed because Douglas surveyed the area for sale to settlers, mandating it be offered at auction, contradicting the idea of a reserve.
