In 1961, a Florida pool hall was robbed. The only eyewitness identified Clarence Earl Gideon as the culprit. Gideon was arrested and charged. When he asked the court for a lawyer to defend him, he was told no. So Gideon, who had no legal training and no money to hire an attorney, defended himself in court. He was convicted and sent to prison. From his cell, he drafted a handwritten petition to the United States Supreme Court. In Gideon v. Wainwright, the Court ruled that the Sixth Amendment guarantees the right to counsel for any defendant subject to criminal prosecution, regardless of their ability to pay. The ruling transformed criminal justice in America and created the modern-day public defense system. Every day in courtrooms all across America, public defenders are on the frontlines protecting this essential American right. On this Gideon Day, we give thanks for these heroic public servants.

We have been told that we have to choose between being tough and being smart, between accountability and second chances, between law and order and reform. That is a false choice.” The First Step Act proved that taking a data driven and outcomes focused approach to public safety can reduce recidivism and produce positive outcomes for people in the justice system and communities. If signed, this bill creates a clear path to early termination for people who have worked hard and done everything right while on probation—complied with the conditions of their supervision, maintained employment, completed treatment, and demonstrated they are not a public safety risk to the community. Andre spent 10 years on probation despite doing everything right: pursuing education, building a business, participating in treatment, and making steady progress. Despite being promised the opportunity for early termination by his probation officer after two years, he ended up serving his full 10-year term. For far too long, Virginians like Andre have needlessly spent years of their lives under supervision, with their progress and achievements going unrewarded. Now, all of that can change. Join Andre in celebrating the passage of HB 149/SB 136, legislation that would create a simple, common-sense path off probation. Exciting news from VA!! As a former probation officer, I’ve seen people work incredibly hard to rebuild their lives while on supervision. When someone has done everything right, there should be a clear path forward. Charles “Duke” Tanner (@dukegotlife) was a pro boxer trying to provide for his family. But “the money wasn't coming fast enough,” he says, “So I chose the streets—because that’s what I knew.” His first-time drug offense led to a double life sentence meant Duke had to leave his 2-year-old son behind. Determined to be reunited with his family, Duke spent nearly 2 years writing to the White House. He was eventually released in 2020 thanks to Pardon Czar @alicemariefree. But coming home didn't mean freedom; he was bound by punitive supervision conditions. “Instead of helping you get a job or do the right thing, they’ll violate you.” In 2025, he got a presidential pardon from President Trump. Now, Duke is using his story to advocate for The Safer Supervision Act. 🚨 What if you earned your release, and were still kept in prison? “The First Step Act was designed to confront an epidemic of over-sentencing, particularly for non-violent and first-time offenders. Its purpose was straightforward: to move eligible inmates out of prison earlier and into structured pre-release custody so they could work, pay taxes, secure housing, and reconnect with their families while still under supervision.” In a new op-ed in The Hill, Peter Navarro, White House Senior Counselor for Trade and Manufacturing, (@RealPNavarro) argues the law isn’t being carried out as written, and thousands of eligible people aren’t getting the time credits they earned. A recent Government Accountability Office report found that nearly 30,000 people were kept behind bars longer than legally allowed. It gets worse: - 65,000 late payments to contractors - $12.5 million in penalties - Halfway houses paid late about 70% of the time - 71% didn't receive the time credits they earned Passing a law is step one. Wallace spent 19 years in federal prison. When he came home, he got his life on track. He got a job and paid his restitution. And in the short span of just five years, he had earned his associate, bachelor’s, and master’s degrees. All while caring for his mom who was suffering from cancer. But none of that mattered. On a family trip, he was pulled over and detained for an hour while police waited for the federal probation office to open for the day just to confirm he had permission to travel. He did. This is federal supervision right now. Probation officers stretched thin by high caseloads, spending precious time on verification calls instead of focusing on the cases that actually need attention. This doesn't make anyone safer. It punishes people on supervision who are working hard to move their lives forward. The Safer Supervision Act would change this. It would allow people like Wallace, who are committed to rehabilitation, reentry, and a law-abiding life, to successfully complete supervision. It would mean officers being able to focus their resources where it matters most: on higher-risk individuals who need more monitoring and support. And it would mean families like Wallace's can just keep driving. Safer Supervision is common sense. But it’s also common ground, with 79% of voters in support. It's not a left-or-right issue.
