On February 18, 2026, RWC-340B sent a letter to @EliLillyandCo's CEO objecting to the drug manufacturer’s policy requiring covered entities to submit claims-level data for all 340B utilization. We called their new policy an unprecedented and unequivocal violation of federal law.
Days later, @novonordiskus announced that it was implementing the same data requirements for all 340B claims, so we sent a letter to their CEO too. Their policy might not be unprecedented, since Eli Lilly tried it first, but it too is an unequivocal violation of federal law.
The policy violates the 340B statute and the pharmaceutical pricing agreement with the Secretary of Health and Human Services by overcharging covered entities that refuse to acquiesce to their conditions. Moreover, the policy would result in significant administrative costs impacting RWCs’ ability to care for our patients.

HRSA is seeking comment on a proposed rebate framework that would fundamentally change how the 340B program operates.
For Ryan White Clinics and other safety-net providers, this is not a technical adjustment – it is a structural shift that would:
• Move financial risk onto providers
• Increase administrative and compliance burden
• Create uncertainty around whether rebates are paid
• Divert resources away from patient care
340B savings sustain medications, primary care, mental health services, and case management for low-income and uninsured patients – at no cost to taxpayers.

A major win for the 340B community: DOJ has told the First Circuit it plans to drop its appeal and pause litigation over HRSA’s 340B rebate pilot, signaling the agency will return the policy for reconsideration. The government and hospital plaintiffs are now in discussions to send the rebate model back to HRSA, following court rulings that faulted the agency for failing to follow proper process and account for the real-world impact on providers.
This is a clear sign that provider advocacy is being heard - and that flawed policies that would have disrupted patient care and the 340B program are being reevaluated.

You might ask why we continue to stand on our soapbox and defend 340B. Well, the answer is simple: patients need it, rely on it, and often would not receive healthcare without it.
