The Kenyan government has given Elon Musk a 3-month ultimatum to establish a local office for X in Kenya or risk regulatory action, including possible suspension of the platform. ICT CS William Kabogo told the Senate that X is currently operating under temporary approval licences, with the local office requirement aimed at strengthening accountability and ensuring the platform complies with Kenyan laws. The government says the move is part of a wider crackdown on harmful online content, cyberbullying, deepfakes, misinformation, and explicit material, especially to protect children and vulnerable users online. Kabogo also stated that the Communications Authority of Kenya now has the power to suspend digital platforms such as X, TikTok, and Meta platforms if they violate Kenyan regulations or fail to comply with government directives.

Just to remind you, the VASP bill gives authorities the power to seize your seed phrase and even your cold storage devices. That means even the crypto you store off exchanges is not safe from them. Once a court issues a seizure order, authorities can physically come to your home or office, take your Ledger or Trezor, take your written seed phrase, and transfer everything in those wallets to a government controlled wallet. The fun bit, there is no clause requiring them to return assets that turn out to be unrelated to the investigation. If you're a crypto person, this is a wake-up call. Stop storing your hardware wallets and seed phrases on your work table.

This is what might happen: ➜Exit Kenya completely ➜Get licensed ➜Operate illegally. What they are required to do: ➜ Establish a local subsidiary or branch. ➜Must be incorporated or registered under Kenya's Companies Act ➜Must respond to all freezing and seizure orders from DCI, ARA, and courts. ➜Provide evidence of paid-up capital ( Ksh 150M) ➜Must file monthly transaction reports to CBK/CMA. So far, we have already seen cases of fund freezing, which means they are already following the compliance path. This also applies to all other foreign exchanges operating in Kenya, including OKX, Bybit, Bitget and the rest. We might see a few exits when that time comes, but from the current look of things, Binance won't go anywhere .

I am among a few who have proposed a general strike to bring the economy to a standstill but unlike others I am not naïve about it. If everyone has to stop work, business, travel, etc. for a whole week or two then people need to prepare well e.g. stock up on essentials like food and water, set up mutual aid groups to assist the less fortunate and the struggling, etc. But the preparation for such a huge endeavour is a conversation most Kenyans are unwilling to have. A nationwide strike in any sector require preparation to be sustained and successful. It cannot be anchored on spontaneity and emotions.
