THE TRUTH ABOUT COUNCIL TAX — KNOW YOUR RIGHTS (UPDATED) Most people don’t realise that Council Tax is not a lawful requirement and that councils across the UK are breaching your common law rights, human rights, data protection rights, and even international law every single day. Here’s what you need to know: • Council Tax is a civil matter, not a criminal offence. There is no signed contract between you and your local council. Without a contract, there is no obligation under Common Law. You cannot be lawfully forced to pay a debt you never agreed to. • Councils are private corporations, not true government bodies. Every council operates as a private business (with a D-U-N-S number) they serve their own financial interests, not yours. • Liability Orders are unlawful. Since 2003, “liability orders” have not been lawful court orders they are administrative notifications. The whole process of the liability order is fraud because section 34 of the council tax administration and enforcement regulations 1992 require a justice of the peace to look over the summons. They admit themselves it's a fully automated process Hundreds are rubber-stamped without any real hearing, violating your right to due process. Liability Orders cannot be considered to be court orders because there is no Memorandum of Entry in the Magistrates’ Court Register. The Memorandum of Entry relates to Rule 16 of the Magistrates Court Rules 1981. Rule 16 for legal purposes can only be evidenced by a memorandum of entry, or Rule 68 a certified extract from the register. Additionally, HMCTS, by a Freedom of Information response, has confirmed that the only indisputable evidence of this alleged liability order being granted is by producing a certified copy of the Memorandum of Entry from the Courts Register, which is a legal obligation under the Magistrates’ Court Rules 1981, Rule 66(1)(a), and at 66(2) details that the order must show the name of the alleged debtor. Most Liability Orders do not show the name of the debtor or the name of the Justice of the Peace. legislation.gov.uk/uksi/1981/552/… • Bailiffs are acting unlawfully. Bailiffs are often instructed without a judge-signed warrant, using unlawful liability orders. Their actions breach your data rights, property rights, and human rights. Laws and Rights They Are Breaking: • Human Rights Act 1998 – Article 6: Right to a fair trial. You are being denied your right to defend yourself before a neutral judge. • Magna Carta 1215 – Clause 39: No free man shall be fined or stripped of property without lawful judgment by equals or by the true law of the land. Bill of Rights [1688] Grants of Forfeitures. That all Grants and Promises of Fines and Forfeitures of particular persons before Conviction are illegal and void • Bill of Rights 1689 – Section 12: Fines or forfeitures before conviction are illegal and void. • The Bills of Exchange Act 1882 - a bill of exchange as an unconditional order in writing addressed by one person to another, signed by the person giving it, requiring the person to whom it is addressed to pay on demand or at a fixed or determinable future time a sum certain in money to order or to bearer • Data Protection Act 2018 / GDPR (General Data Protection Regulation): Your personal information is being shared unlawfully with bailiff companies, violating GDPR Article 5 (lawful and transparent data processing). • Common Law (Natural Law Principles): The true law states: no harm, no loss, no injury, no fraud = no crime. Council Tax causes no harm → under natural law, it cannot be lawfully enforced. • Fraud Act 2006 – Section 2 (Fraud by false representation): Presenting unlawful administrative liability orders as legitimate court orders could constitute fraud. I have had conversations with senior members of Pakistan's law enforcement agencies. Their position is as follows: There already exists a Pakistan Prisoner Transfer Treaty with the UK, which was agreed in 2018. Not once has the UK government invoked it. They deplore the abuse of children. Until recently the punishment for paedophilia in Pakistan was the death penalty. Any deportees from the UK would be at leisure to repent in less than comfortable Pakistani prisons where fellow prisoners will not take kindly to them. They think the UK has lost the plot with the ECHR, protecting criminals rather than victims. They would gladly take back any and all Pakistani nationals who have committed a crime in the UK BUT Not a SINGLE application has been made to the Pakistani authorities. The fault lies in our immigration policy and our failure properly to prosecute and punish criminals. Unless and until the UK government seeks deportations to Pakistan, there is nothing Pakistani authorities can do to ameliorate the problem.
