@JayOfficials1 @markgomez1111 @libsoftiktok I've never been concerned about my ability to understand legal concepts. My concern has always been about the ability of Judges, Police, Prosecutors, Juries, etc, to properly understand legal concepts. Evidence is mixed on that point. 😏

The gist was: "If a child walks in on their parents "doing it" is that a crime?" A real lawyer would never ask that.

🚨 ALERT - New Jersey can now ARREST I.C.E. and other federal agents for wearing a MASK, with potential JAIL TIME. Yesterday, Governor Mikie Sherrill signed into law the "Law Enforcement Officer Protection Act" which: - Bans most masked interactions by law enforcement, including federal agents and ICE officers - Requires federal officers to identify themselves before arrests using uniform, ID, badge, or verbal disclosure If any federal officer is caught wearing a mask during operations, they would be guilty of a disorderly persons offense, which includes up to 6 MONTHS IN JAIL! If you will read my initial comment on this. I said I theoretically agree with this type of prohibition. But, any time a govt at any level attempts to insert itself into our private lives, we should stop and very seriously consider this. Govts are not neutral players. See, Nobel Prize Economist James Buchanan's work. Power is never given back to the people once its granted to the govt.

@JayOfficials1 @libsoftiktok The process is the punishment for most people. Look what happened to Trump and his supporters. Lives were ruined by the prosecution regardless of the outcome. Trump could afford the process or he would have gone down as well. Not many can afford to do what he did.

@Retired6270 @libsoftiktok The US courts process around 20 million criminal cases per year. There are multi-layered appeal systems in place for if they get things wrong. The notion to not act on child sexual grooming, because the courts might sometimes get it wrong... Our Priorities are not the same.

From the bill text amending ORC 2907.09: "No person shall recklessly do any of the following, under circumstances in which the person's conduct is likely to be viewed by and affront others..."

Criminal liability requires reckless exposure/performance under circumstances likely to affront non-household members including children. Accidental acts lack that element. This ain't rocket science.

If that is directed at me, this is my response. I actually was a very senior Federal lawyer for half my career. The other half was spent representing those who couldn't afford a lawyer to defend themselves. In both roles I got a close up view of how govt's behave. That may be the basis of my scepticism about govts. I acted for and defended against the govt for 40 years. Take it for what its worth.

@JayOfficials1 @libsoftiktok We'll agree to disagree on this. If you trust a govt to interpret and enforce laws in a fair way, you're either naive of just foolish. Look at current differences between Blue and Red states, or in the United Kingdom, as far as how "Laws" are enforced and prosecuted.

If you were, you would not have had trouble with the role that intent plays in a crime...and the concept of accidental or incidental exposure would not have baffled you.
