Bu, antlaşmayı fiilen ihlal etmektir. Batı Trakya’da yaşayan yaklaşık 120-150 bin kişilik nüfusun ezici çoğunluğu etnik Türk’tür. Bu topluluğun ana dili ve isimleri Türkçedir. Ayrıca Türk kültürü ve tarihî hafızasıyla kendilerini açıkça Türk olarak tanımlar. Pomak ve Roman unsurlar da var olmakla birlikte sayıları oldukça azdır. Yunanistan’ın “Müslüman Yunan” diye yeniden tanımlama çabası, bu insanların kendi kimlik hakkını inkâr etmekte ve sistematik asimilasyon politikasını gizlemektedir. Avrupa İnsan Hakları Mahkemesi, Tourkiki Enosi Xanthis, Bekir-Ousta, Emin ve Diğerleri ile en son Sağır ve Diğerleri v. Yunanistan (2025) kararlarında Yunanistan’ı defalarca mahkûm etmiştir. “Türk” kelimesini içeren derneklerin kapatılması ve seçilmiş müftülerin yerine devlet ataması, hem Lozan Madde 40’ı hem de AİHM 11. maddesini ihlal etmektedir. Yunanistan bu kararları yıllardır uygulamamaktadır. Batı Trakya’daki Türk varlığını inkâr etmek hukuki veya tarihî bir gerçek çarpıtmasıdır. Lozan Antlaşması, tarihî belgeler ve AİHM kararları, etnik Türk azınlığın varlığını ve haklarının korunması gerektiğini net şekilde ortaya koymaktadır. Bu inkâr, Türklerin varlığını değiştirmeyecektir.
