The judge in the Wisne case just clarified her ruling today after the NCAA asked. I'm a baseball guy, so this is through a baseball lens. Fifth year eligibility is protected. The judge said her clarification changes "zero percent" of her analysis. If you're in the 2022 class, you're covered automatically. Roster caps still apply. Teams can only carry 34 plus DSAs come December 1, so a returning player counts against the limit. House settlement rev share caps didn't change either. But fall rosters run larger, and coaches have more flexibility before that date. Transfer rules were not touched. If you go back to where you played, easiest move, no portal needed. If you graduated you can go anywhere with no window restrictions. Undergrads without a degree need a portal window and baseball's is closed right now, but there are reports a special window may be coming. The sleeper issue is restitution. The NCAA's restitution rule lets them retroactively punish schools and athletes, vacated wins included, if the injunction gets reversed later, and this order doesn't explicitly block it. Other courts have already blocked it in these exact cases, Pavia and Ohio both. Watch for class counsel to seek that same express protection here. One thing though. The risk splits completely by sport. Football and possibly basketball players will have games on the books by any reversal date, so their schools are betting real, vacatable results on the appeal as of right now. Baseball and spring sports play nothing that counts until February, by which time the appeal will have shown its hand. Different sports, completely different risk. Bottom line: as of right now, the year is protected, except if overturned on appeal or if the PCSA becomes law without protection for enrolled athletes. An emergency reversal in the next week got much less likely once the judge cured the NCAA's best technical argument within 24 hours. But be clear about what "protected" covers: the 5th year, and the 5th year alone. The roster spot, the money, the restitution risk, none of that is the court's doing. Everything else runs under normal NCAA rules. This is where it stands today as far as I can tell. If you see something that I've missed, pease let me know.
