@ubomiabumanga_ When it comes to bail in schedule 6, it doesn't need to be. The applicant (accused in this case) has the onus to discharge. The state will however need an airtight case when it comes to the main trial.

@pushkins798 I'm highly interested in the exact reasoning for this judgment. The court may have found the weakness of the state's case is not enough to show exceptional circumstances for Bafana Mahungela to be released on bail. #KirstenKluyts

There seems to be no evidence that Bafana Mahungela murdered #KirstenKluyts. Stumbling upon her body, undressing her body, wearing her T-shirt and dumping her clothes is defeating the ends of justice, not murder. He will probably be released on bail.

@90_thando The bail application is not a determination of guilt. The magistrate was at pains to express that. The rationale appeared to rest on his actions after her death, particularly not reporting and the elements of the clothing

Investigations are still ongoing. State has no case and bail got denied. How is that even possible? How do you conclude #BafanaMahungela is a danger to the society without substantial evidence though? #KirstenKluyts

@slindors According to the court's judgment, it hinged on his behavior after the death; significant that he didn't come forward (even anonymously as considered by the court)

I really thought Mahungela would be given bail. Can't see how Bafana is a threat to society? Could it be his demeanor during the bail application? #KirstenKluyts

The public needs to understand that bail is not a determination of guilt. It's a balance between interests in the interim leading up to the trial with additional requirements under schedule 6. The court's rationale must focus on that #KirstenKluyts
