Fascinating scoop here. One of AG Garland's hand-picked advisors on J6 investigation and Trump cases raised serious concerns over the Mar-a-Lago raid. Garland had tasked Patty Stemler, a longtime, well-connected DOJ official, to advise on the political matters. (She had retired as head of the DOJ's top criminal appellate attorney in Feb 2022 and was named "senior counsel" at DOJ.) A few days after the raid, Stemler sent an email to a DOJ NSD attorney with questions. “I didn’t know about this search in advance, but I have been worrying about it ever since and worrying more now,” Stemler wrote in an Aug. 10, 2022 email. “Doesn’t Trump maintain that he had the authority to declassify documents while he was still President?" She continued: "Has anyone in NSD or OLC [Office of Legal Counsel] looked at that? I know we have procedures for declassifying, but is the President as Commander in Chief bound by those procedures? We also have procedures for granting pardons, but the President doesn’t have to follow them. I don’t know if we intend to charge anyone with respect to the classified documents seized yesterday, but if we disclose that we found X classified documents before we seek an indictment, will that trench on any fair trial rights or violate the ethical obligations of a prosecutor?" Stemler, known as the DOJ's "fixer" in tough cases, had more questions. She represents yet another top DOJ official expressing not just concerns about the raid (add WFO chief Steve D'Antuono, who fought Jay Bratt and others for weeks) but the basis for an investigation into a former president's holding of classified files.

After the State Department aired its concerns regarding Islamic Relief Worldwide, Cornyn still had kind words for its American branch. Tonight, ICE law enforcement officers were assaulted by anti-ICE rioters who sprayed law enforcement with an unknown chemical substance. DOJ SUPREME COURT WIN: The Supreme Court yet again reversed the Fourth Circuit, this time with a unanimous 9-0 decision. As the Department of Justice argued, the Fourth Circuit was wrong to try to rewrite a statute about the process for resolving government employee complaints. This unanimous result reflects a key principle we fight for: judges should be judges resolving the case before them, and should never try to seize Congress’s role. This opinion sends a clear message: lower courts must accept that the law is the law, no matter the “political controversies of the day,” as the Supreme Court rightly emphasized.

I was proud to endorse @KenPaxtonTX early in the runoff election because I was tired of watching the Senate do nothing to pass the SAVE America Act. The voters of Texas agreed.

Fun story… More than any other senator, RINO witch Lisa Murkowski killed SAVE Act. I am constantly hearing from GOP sources how Murkowski screams and rants and raves against voter ID. She threatened to go independent over it. Thune is terrified of her. But why is Murkowski even a senator in the first place? She lost the Alaska Republican primary in a landslide in 2010 to Tea Party candidate Joe Miller. But John Cornyn and GOP Senate leaders stepped in to save her… Cornyn poured millions into a shady write-in campaign that gathered thousands of illegitimate votes to drag Murkowski over the line on Election Day. Now Cornyn has LOST his seat because Murkowski refused to back the SAVE Act. Betraying your base will always destroy you in the end. Just a reminder that GOP Senate Leaders HATES the Republican base more than anything on earth and would rather LOSE their seats than serve the will of the voters.
