Section 230 has protected internet service providers from lawsuits related to harm caused by their products for decades. The Supreme Court has resisted overturning the statute, and Congress, with its coffers funded by Google and YouTube, has had little incentive to change it. However, personal injury attorneys and a jury of 12 have finally delivered a resounding message: we are not to be controlled by algorithms. Many were surprised by the decision, but after a lengthy trial in which Mark Zuckerberg testified, the jury learned about the substantial efforts made by social media companies to manipulate the brain and keep children addicted. While future lawsuits may not dismantle social media companies, this ruling will ensure that the “move fast and break things” era comes to an end.
