Expect the illegal entry arrest provision to draw a legal challenge once someone is arrested under SB 4. Until then, there's a standing issue.

Specifically, Ezra strikes down provisions allowing for arrests for illegal re-entry and for state judges to initiate deportation proceedings of those arrested. Going into effect Friday is a third provision allowing for illegal entry arrests. That wasn't challenged.

Judge David Ezra had words for Gov. Greg Abbott (R) who signed the soon-to-be enjoined law in 2023 after clashing with Biden over the border. “Greg Abbott was a good lawyer, Greg Abbott was a justice on the Texas Supreme Court, Greg Abbott knows the law."

The injunction won't stop a provision of the state-level law allowing for arrests for illegal entry because the plaintiffs didn't challenge it. It'll perhaps draw its own lawsuit once someone is arrested under that provision.
