The Supreme Court on Thursday left in place a ruling by a federal appeals court in favor of an Alabama man who has been on that state’s death row for more than two decades.

The final update of the morning is in Hamm v. Smith, which has been dismissed as improvidently granted. In Hamm, the court considered how to analyze multiple IQ scores when a defendant claims that he is intellectually disabled and cannot be executed.

The 2nd op is Havana Docks, on whether a U.S. company can recover from cruise lines that used docks in Havana from 2016-2019. An 8-1 court reverses a decision stating that it could not recover because interest in the docks would have expired before 2016.

The first opinion is in M&K Employee Solutions, on withdrawal from multiemployer pension plans. Court unanimously holds that, under ERISA, actuaries can select the assumptions that underlie the withdrawal-liability calculation after the measurement date.

The 2nd and final opinion is in Jules v. Andre Balazs Properties, on whether a court that has previously put claims in a pending action on hold has the power to confirm or vacate a resulting arbitration award. The court unanimously holds that it does.

The first opinion is in Montgomery v. Caribe Transport II, on whether freight brokers can be held liable for negligent hiring. In a unanimous opinion from Barrett, the court holds that a claim that one company negligently hired another can move forward.
