Today we've published Baroness Harriet Harman KC’s independent report on bullying, harassment and sexual harassment at the Bar. Baroness Harman has set out 36 detailed recommendations to tackle what she describes as a culture of “impunity” and "collusive bystanding". Hundreds of those working in and around the Bar contributed to the review including pupils, junior and senior barristers, and those employed in chambers. The report is thorough and detailed but it makes for uncomfortable reading. The Bar is a wonderful profession, but the impact of bullying and harassment on individuals is huge – and that’s why we commissioned the independent review. It’s imperative that all barristers, aspiring barristers, and our chambers colleagues have a safe and inclusive working environment. We continue to argue that there is no need to curtail the right to trial by jury in response to the recommendations made in Sir Brian Leveson's report on criminal courts published today.
This is from both a principle and practical position. Juries represent society and are a fundamental part of our system.
Sir Brian's report recognises that it is the failure to invest properly in the justice system over decades that has led to the crisis we see in the criminal courts today.
Our Chair Barbara Mills KC said: "Changing the fundamental structure of delivering criminal justice is not a principled response to a crisis which was not caused by that structure in the first place."
We welcome the focus on diversion from the criminal justice system in the report such as its focus on out of court disposals and greater investment in rehabilitation programmes - suggestions we put forward in our submission.
