@SKDaddy1 @Chatswith_X Hhayi dude, Act 13 list offences but no where does it authorise citizens arrests which is what is in Act 51 (limited to Schedule 1 offences). Act 13 section 42 (13) makes it clear that it’s illegal to impersonate or pretend to be an immigration officer.

@SKDaddy1 @Chatswith_X 42 and 49 are prohibitions not authorisations as you are inferring from section 42 of CPA. I am not a lawyer but my simple understanding of the English language does not support your argument. I trust that maybe your arguments are based on supporting case laws

@Chatswith_X @SKDaddy1 I am sorry, I am no lawyer but I think you misinterpreted section 42 (1) c. "Any other law" you mention is about where that law gives authority to the private person to enforce Section 42. Act 13 of 2002 gives enforcement power to immigration and police officers

@Owuraaddo @Chatswith_X Paragraph c gives you another instance of any other law that gives a citizen authority to use or rely on section 42 of act 51 of 1977 to effect the warrantless arrest..

@SKDaddy1 @Chatswith_X Familiarise yourself with Refugees Act as it’s the only act that deals with foreigners insofar as their legality in being in SA & what trade they can or can’t do & not Immigration Act 13. We keep on drumming this R5m investment even on refugees & asylum seekers.

@nkosijhb @Chatswith_X Read I gave the relevant statutory bring section 42 and 49 of act 13 of 2002. First understand those offences and the uou will understand why they can be arrested.

@nkosijhb @Chatswith_X Bro I specifically referred you to section 42(1)(c) to address this but you are choosing to ignore that.

@nkosijhb @Chatswith_X I have just unpacked section 42 of act 51 of 1977, specifically section 42(1)(c) and I have given you the other law being sections 42 and 49 of Act 13 of 2002.

@Chatswith_X @SKDaddy1 you’re misinterpreting and butchering our laws. There’s no such authority for the private citizens arrest you’ve mentioned.
