This is pure price gouging, with a side order of partisan political propaganda.
Under Section 301, tariffs on Chinese goods passing through Canada (where Spier and Mackay are headquartered, and whence all goods are dispatched according to their website) are still charged at the Chinese rate, which is 125%. The amount that they are charging is 170%, so right off the bat, they are charging more than just the tariff. So the tariff should be reduced from $154.68 to $113.74. There is $40.94 worth of gouging. But it gets worse.
Tariffs are paid on WHOLESALE value, not RETAIL. Spier and Mackay typically have a markup of around 400%, so that $91 shirt has a wholesale value of about $18.20. So the tariff should be reduced from $113.74 to $22.75. Another $90.99 in price gouging. But it still gets worse.
Total direct-to-consumer goods orders of less than $800 value are EXEMPT from U.S. tariffs and import duties. So the tariff should be reduced from $22.75 to $0, a further $22.75 in price gouging. But, somehow, it STILL gets worse.
On direct-to-consumer orders, the CUSTOMER is responsible for import duties. The retailer doesn't enter into the equation AT ALL, so there is no circumstance under which a Canadian retailer should be showing tariff-related charges to the end customer AT ALL, let alone charging them for it directly. We're bordering on an illegal business practice now. At minimum, it's EXTREMELY shady.
Notice that they call the surcharge a "tariff charge." The inclusion of the word "charge" is no accident. It's legal cover; if they called it a "tariff" or "import duty," it would clearly violate the Consumer Protection Act. There's a strong case to be made that they're already in violation anyway.
Total price gouging on that bill, for those keeping track, is $154.68. Total actually being paid as a tariff to the US government is ZERO. ZILCH. NADA.
