The press release is below but the actual interpretation and guidance from the SEC is 68 pages long and can be found here: sec.gov/files/rules/in… This clarifies how the SEC will treat crypto assets under current securities laws. It is not effective until published in the federal register. Most importantly, once effective, it will only remain effective until a future administration chooses to revise it. This is a major positive but demonstrates exactly why the CLARITY Act must be enacted. Highlights: - Does not replace Howey test, but rather details how it will be interpreted; -Names (i) digital commodities; (ii) digital collectibles; (iii) digital tools; (iv) stablecoins; and (v) digital securities as types of crypto assets. -Actually lists several crypto assets as commodities and not securities, including APT, AVAX, BTC, ADA, DOGE, ETH, LTC, DOT, SHIB, SOL, XLM, XTZ, XRP -hallmarks of being a commodity include having a "functional" system -meme coins are digital collectibles, which are also not securities -tokenized securities are securities - assets sold as part of an investment contract may not remain securities forever -failure to fulfill promises made can still be fraud -even if an asset becomes a non security, that does not wash away previous securities law violations -mining (including mining pools) and staking, do not involve the offer for sale of a security -for airdrops, it all depends on the expections of the recipients (based on announcements of the issuer) when the performed the activity that gained them access to the airdrop
