I was interviewed for this documentary about the trial of Lucy Letby on Channel 5 at 9 pm tonight. channel5.com/lucy-letby-the… To answer the specific question in the title, I do not know whether she is guilty but I strongly believe we need to reform our justice system so science and statistics are more fairly represented in trials of this complexity, so the jury can hear the complete picture. I am reposting my further thoughts below to avoid any confusion. I would also point out that I’ve been in contact with Dr. Dewi Evans, the chief expert witness for the prosecution, and have asked him to explain in each of the 14 cases of murder or attempted murder, why he believes she is guilty beyond reasonable doubt. I hope to publish this in Private Eye in due course, with commentary from other experts in this area who believe more natural causes or human error were more plausible. I hope this will then provide the balance that should have been provided in the trial. My first @PrivateEyeNews column on the trial of Lucy Letby is now available online. private-eye.co.uk/special-report… My second column on Letby is in the current issue of @PrivateEyeNews For those who don’t have time to read it, I would make the following points. 1. The UK doesn’t have a death penalty anymore, but we have served the most severe sentence we can to Letby - incarceration for life - so we need to be absolutely sure we’ve got it right. 2. Getting it right in a legal context means being sure beyond reasonable doubt. 3. Numerous credible experts across multiple scientific disciplines have expressed reasonable doubts about the verdicts after the trial, arguing that the deaths and harm more likely happened from natural causes in an overstretched unit. 4. The proper place to hear such expert evidence was in the trial, but for reasons that are undetermined, the prosecution fielded six expert witnesses and the defence fielded none. 5. The expert evidence the jury heard was unsurprisingly very one-sided. Although experts are supposed to be independent whoever they work for, it is very hard to be unbiased when your livelihood depends on putting forward a side of the science that supports your client, and makes it more likely you’ll be employed in future. 6. For the jury to hear the whole picture of the science and statistics of a trial, it should be mandatory for equivalent experts to be funded and appear for either side. 7 Even better, in my view, a team of the best practising experts in trials of this importance should be provided on behalf of the Court, not one side or the other. They should read the evidence first and provide a written report for the CPS. If the case proceeds to trial, they appear purely on behalf the Court and can be cross-examined by both sides. 8. I cannot say whether the Letby is guilty or innocent. But on the basis of expert opinion that has emerged after the trial, I think there are reasonable doubts about murder in some or all of the cases that the jury should have heard from experts for the defence. On that basis, I think she should have an appeal with the science and statistical evidence being heard in its entirety. 9. The verdict may still be the same, with the opinions of seven paediatricians who worked alongside her being very persuasive. But she was never caught in the act, there is no Internet evidence of her researching the varied and unusual methods of murder and she maintains her innocence. So I think an appeal is in order, however painful and expensive it may be.
